Again, I am NOT on some sick "I love you Darren" fan club type kick. I knew Darrin before the insanity; this is where comprehension of what you read is necessary. Pay attention to the dates when things were written, this might help the slow thinkers out there like the woman above.

In case you don't know the differnce between a Alfred Plea and a Guilty plea:

Aflred Plea: A plea in which the defendant agrees to enter a specific plea as being in his or her best interests because the prosecution might well be able to convict the defendant and the sentence could then be more severe, but under an Alfred Plea (also called a "best interests plea") the defendant never admits guilt and may in fact continue to proclaim his or her innocence

Guilty: having been convicted of a crime or having admitted the commission of a crime by pleading "guilty" (saying you did it). A defendant may also be found guilty by a judge after a plea of "no contest," or in Latin nolo contendere. The term "guilty" is also sometimes applied to persons against whom a judgment has been found in a lawsuit for a civil wrong, such as negligence or some intentional act like assault or fraud, but that is a confusing misuse of the word since it should only apply to a criminal charge.

Darren Mack heard opening statements in Clark County District Court Wednesday during his murder trial in Las Vegas. Mack is accused of killing his wife, Charla, in June 2006, and shooting of Family Court Judge Chuck Weller.

LAS VEGAS -- In the months before the stabbing of his wife and the shooting of a judge, Darren Mack had become increasingly delusional about his volatile divorce and court battle, snapping when his estranged wife held a gun in his face and was willing to pull the trigger, his lawyers told the jury Wednesday.

But Special Prosecutor Robert Daskas painted Mack as an angry bully who meticulously planned the stabbing of Charla Mack to avoid paying her thousands of dollars and took aim at their divorce judge in retaliation for his rulings.

After weeks of a painfully slow process, lawyers settled on 12 jurors and three alternates Wednesday morning and made opening statements in what is expected to ba a four-week trial.

Mack, 46, is charged with murder in the June 2006 stabbing death of his estranged wife, Charla, 39, and attempted murder of their divorce judge, Chuck Weller. Mack could face life in prison without parole if convicted.

His lawyers conceded Mack committed the crimes but said the killing was in self defense and that he was legally insane when he shot Weller through a courthouse window.

Mack was captivated with Charla when they first met, his lawyer Scott Freeman told the jury. She was funny, beautiful, smart and physically fit, he said.

But Mack soon learned of her other side, he said. In a moment's notice, she could turn violent and abusive and had hit, punched, pushed, screamed and thrown things at Mack over the years, Freeman said.

The Darren Mack murder trial may not have a jury by the end of this week.

The Reno pawnshop owner is accused of killing his wife and shooting their divorce judge in June 2006.

Mack got his trial moved to Las Vegas in part because jury selection went too slow here in Washoe County. It's now taking place at the Clark County Regional Justice Center.

After three days in Reno, they had 12 people in the jury pool when Judge Douglas Herndon put a stop to it. On day three in Las Vegas, they have 15 people selected - only three more.

Lawyers are finding a good percentage of people qualified to serve though.

Defense Attorney Scott Freeman: "He (Mack) didn't know the difference between right and wrong at the time the judge was shot. Is that a concept that you can accept, or is that something you go ‘hey, you know that's way out there for me. I'm not good with that.'"

Anonymous: "No."

Freeman: "That's something you could accept?"

Anonymous: "Yes."

Mack's lawyers are ready to put on an insanity defense and they want people who won't reject that concept. They're also asking about self-defense, sentencing options and whether graphic autopsy photos would throw them off.

Prosecutors wanted to make sure people understood the burden of proof is entirely on the state, that the defense doesn't even have to put on a case.

Special Prosecutor Robert Daskas: "There's a difference certainly between expecting them to do something and requiring them to do something."

After a painfully slow attempt to put a jury together in Washoe County, the judge in the Darren Mack murder case decided Thursday morning to move the trial to Las Vegas.

The judge plans to start over with the jury selection process starting October 15th.

Before ordering the trial moved, he asked Darren Mack personally if that's what he wanted and Mack replied, "very much so, sir."

After three slow days of questioning jurors, one of which he called a 'disaster,' Judge Douglas Herndon had enough and he ordered Mack's trial moved to Las Vegas. "As far as I'm considered, it's one of the most significant issues in the case."

Mack's attorney, Scott Freeman, touted the decision as a major victory for the defense. "There's going to be people who haven't heard of this case and Mr. Mack is going to get a fair trial in Las Vegas."

From the outset, defense lawyers questioned whether Mack, a former wealthy pawn shop owner, could get a fair trial in a case that generated nationwide media attention and led to intense legal maneuvers.

All Washoe County judges were recused from hearing the criminal case or any civil suits stemming from it because of concerns of prejudice. And District Attorney Dick Gammick removed himself because of his long-standing acquaintance with Mack.

Herndon is a Clark County judge who was brought in to hear the case.

Attorneys on both sides of the Darren Mack case told the judge Friday they're ready to begin trial on October 1.

At Friday's hearing, Judge Douglas Herndon of Las Vegas decided not to put together notebooks of evidence for the jurors in the case, instead relying on digital projectors to help jurors see evidence as the attorneys go over it all.

Herndon set one more pre-trial hearing for Thursday, September 27 to discuss Mack's plea of Not Guilty by reason of insanity. "We've already entered that plea and the question is how we're gonna utilize it as part of our trial strategy and we're still working on that and so is the state."

The state's prosecutors declined to go on camera, but do say they're ready for trial.

They'll also discuss some pieces of evidence, including emails between Washoe County District Attorney Dick Gammick and Darren Mack in which Mack is believed to have admitted to killing his wife Charla Mack and shooting Judge Chuck Weller.

Gammick may be called to testify at the hearing.

At Friday's hearing, Herndon also discussed audio tapes that prosecutors have. It's not clear if these tapes contain phone conversations between Gammick and Mack, but defense attorney Scott Freeman says Mack has not given any interviews to law enforcement.

On October 1, jury selection will begin here in Washoe County.

The defense has asked for the trial to be moved out of the area, but the judge cannot consider that request without first trying to put together an impartial jury in the case's jurisdiction.

Darren Mack will be in the courtroom Friday for proceedings ahead of jury selection.

Mack is accused of sniping the judge in his divorce case, and killing the wife he was divorcing back in June of 2006.

Friday's motion to confirm trial will be a time for Judge Douglas Herndon to make sure both sides are ready to start on the scheduled date of October 1.

That's when the court will try to pick a jury here in Washoe County, but many speculate the trial will have to be moved.

Mack's attorney Scott Freeman says the defense has already filed a request to move the trial, but Nevada law requires an attempt to find a fair jury in the case's jurisdiction.

"Not surprisingly, there's not many people [in Washoe County] that haven't heard of the case," Freeman says, "equally not surprising: there's not a lot of people that haven't already made an opinion about the case."

If there's trouble finding enough fair jurors here in Washoe County, it would be up to Judge Herndon to decide if and when the case would move.

Unseal records in Mack civil case

The desire of Senior Judge Noel Manoukian to protect accused killer Darren Mack's right to a fair trial is understandable, but the former Nevada Supreme Court justice overstepped his bounds when he sealed the records in a civil case filed against Mack by the family of his alleged victim.

The Reno Gazette-Journal filed a motion last week that asked the judge to unseal documents in the wrongful death case after he gave the newspaper the right to intervene.

The principle that should control a judge's actions is a simple one: The public has a right to know what goes on in the courts. That is particularly true in this already highly publicized case, in which allegations of misconduct have been leveled by Mack's lawyers against the Washoe County jury.

As RGJ attorney Scott Glogovac wrote in his motion, "... there is great public interest in making sure that all proceedings are conducted fairly and without bias."

Yet, Judge Manoukian took it upon himself to seal the documents in the separate civil case, even though lawyers for neither party requested the action, and, in fact, the attorney for Charla Mack's family specifically opposed closing the records.

In the wake of the Legislature's rejection of a bill that would have made it more difficult for a judge to seal court records, it's a troubling decision.

It raises the specter of judges more actively closing the public out of the courts. Judge Manoukian should reject that possibility and unseal the Mack case.

Washoe County District Attorney Richard Gammick lashed out Tuesday at defense lawyers and questioned a judge's ruling that threw out taped phone calls and the alleged confession of Darren Mack, charged with killing his wife and shooting the judge handling their divorce.

Gammick called a news conference to respond to rulings in the case last week by District Judge Douglas Herndon of Clark County, who is presiding over the case in Reno.

Herndon said after a daylong hearing concerning evidence on Friday that Gammick had failed in his duties as a prosecutor by not telling Mack he was represented by lawyers in their conversations while he was a fugitive in Mexico.

On Tuesday, Gammick said a state bar disciplinary panel investigated and dismissed similar issues raised by Justice of the Peace Edward Dannan earlier in the proceedings.

"The State Bar of Nevada found I did not commit any ethics violations," Gammick said, providing copies of a one-paragraph letter from the bar saying the matter was dismissed. The letter did not go into detail.

Gammick also took exception to the judge's ruling that taped telephone conversations between himself and Mack before his surrender could not be used because they were taped without a court order or Mack's consent.

Gammick, a longtime friend of the Mack family, maintained that, because the FBI was involved in the investigation, federal law applied and Mack's consent was not required.

But Scott Freeman, one of Mack's defense lawyers, said the issues Gammick raised were argued by special prosecutors Christopher Lalli and Robert Daskas during last week's hearing before the judge.

"They lost," Freeman said. "We argued the state bar didn't have all the facts."

A lawyer representing Charla Mack, the slain estranged wife of Darren Mack, has asked a judge to appoint a guardian for the couple's 8-year-old daughter to oversee her financial interests and give her the ability to sue her father for damages.

"We're asking that a guardian be appointed to protect the legal rights of Charla Mack's heir," Kent Robison told the judge Tuesday. Robison said the girl's maternal grandmother wants retired District Judge Michael Fondi to become her guardian.

But Mack's civil lawyer, Mark Wray, argued the daughter is being supported by a family trust and such an appointment and lawsuit would siphon funds from the girl's inheritance.

"If we're looking out for the best interest of (the daughter), why have an attorney and guardian take money away from the trust that was set up for her benefit?" Wray said after the hearing. "And why sue her dad for damages that would come from money that she's going to get anyway?

"That's why we object."

Senior Judge Noel Manoukian, who has been appointed to handle the case, did not rule and said he would issue an order today.

Charla Mack, 39, was found stabbed to death June 12 in Darren Mack's garage. Later that morning, their divorce judge, Chuck Weller, was shot by a sniper in his court chambers. Mack was charged with murder and attempted murder. His trial is set for Oct. 1.

Robison filed a wrongful death lawsuit against Mack on behalf of Charla Mack's estate and her mother in November seeking compensatory, special, general and punitive damages. It is not immediately clear when he filed the petition to appoint the guardian because the case files are sealed.

Darren Mack did not confess to murder but admitted he acted in self-defense when he killed his estranged wife, according to court documents his lawyers filed Thursday.

And Mack lawyers Scott Freeman and David Chesnoff said Washoe District Attorney Richard Gammick violated the law by talking with Mack while he was on the run in Mexico last year, because Gammick knew Mack had legal representation.

"Quite obviously, Mr. Gammick took advantage of an individual who was so flustered that he was then willing to stipulate to the death penalty, even while claiming he acted in self-defense," the lawyers said in their response to court documents filed last week by prosecutors.

"Interestingly, the state in its opposition claims that Mr. Mack confessed to Mr. Gammick, but fails to indicate Mr. Mack had stated he acted in self-defense after being attacked by Charla Mack," Freeman said.

Gammick said he violated no laws or rules by talking with Mack because Mack had not personally hired a lawyer at that time. He said the law is clear that there is no attorney-client relationship unless the person in question hires a lawyer.

Mack was charged with one count of murder and another count of attempted murder for the sniper-style shooting of Washoe District Judge Chuck Weller, both on June 12. He pleaded not guilty and not guilty by reason of insanity. Trial is scheduled Oct. 1.

In motions filed last month, Mack's lawyers urged the judge to throw out any statements Mack made to Gammick while he was negotiating his surrender because Gammick was bound by professional obligations and the law against having conversations with a person who was represented by counsel.

Civil suit against Mack on hold

A judge has granted Darren Mack’s request to postpone a civil lawsuit filed against him by the secretary of the judge he is accused of shooting.

In his ruling earlier this month, Sixth Judicial Judge John Iroz said the suit filed by Annie Allison can wait until Mack’s criminal trial is complete.
Postponing the civil suit not only will ensure that Mack has the capacity to defend himself in both cases, Iroz said it also may save the courts and parties money and time.
“In the event — which the Allisons assert is likely — that Mack is convicted, granting a stay would preserve judicial resources,” Iroz said. “A stay in such a situation would prevent the need for investigators and other potential witnesses to testify during multiple trials.”
Allison’s lawyer, Cal Dunlap, said he was disappointed with the ruling, and said he is considering his options.

Hi there, I am a father's rights activists from the state of oklahoma.

Although I certainally don't condone what Darren allegedly did, I can definately sympathize.

I have been involved for quite a while now and the main problem I have seen is the total lack of accountability for these out of control judges. There is absolutely no accountability whatsoever.

Sadly, if the government will not hold these public servants accountable then it's up to the people to do it. This is a Constitutional right to keep and bear arms.

The judiciary is really out of control and "We the People" need to take back the government. It is wraught with corruption.

It seems that when someone finally snaps or whatever you want to call that, then the media dubs them a monster when in reality the issue actually started from a judge who does whatever he wants and whenever he wants to do it and knows no one can or will stop him.

I'm just sorry the shooter missed the judge.

I do feel sorry for the mom and the child though.

"I will ask for the death penalty," Darren Mack told Washoe County District Attorney Richard Gammick, in an e-mail Mack wrote from Mexico one week after his estranged wife was stabbed to death and their divorce judge was shot in his chambers.

"And (I) want it agreed on prior to surrender," Mack said in his list of conditions that Gammick read aloud during one of five conversations that Gammick recorded from June 19 to 22 -- the week after the June 12 crimes.

The transcript of the phone calls was released for the first time on Thursday in a motion filed by Mack's lawyers, Scott Freeman and David Chesnoff. The motion asked the court to throw out those recordings and transcripts because, they say, Gammick recorded the phone calls illegally.

Gammick denies that, saying he had a federal court order to record the calls.

The recordings are the first glimpse of Mack's state of mind after the stabbing and shooting he is accused of committing, and reveals the negotiations that began while Mack was hiding somewhere near Mazatlan, Mexico and ended 11-days later with his surrender in Puerto Vallarta and return to Reno.

Mack was charged with the murder of Charla Mack and the attempted murder of Washoe District Family Court Judge Chuck Weller. He pleaded not guilty and filed a motion Thursday adding "not guilty by reason of insanity" to his plea. His trial is set for Oct. 1.

Soon after Mack returned to Reno, Gammick recused himself and the Washoe County District Attorney's office from the case because of his long friendship with Mack and his involvement in his surrender.

Lawyers for Darren Mack, who is charged with killing his estranged wife and shooting their divorce judge, have added "not guilty by reason of insanity" to his pleas in motions filed Thursday and claimed that Washoe District Attorney Richard Gammick violated the law by recording telephone conversations he had with Mack, who fled to Mexico.

David Chesnoff, one of Mack's lawyers, said he is not seeking criminal charges against Gammick but just wants the tapes that Gammick made to be excluded from the trial.

"It certainly is a felony in Nevada to record someone without prior authorization," Chesnoff said.

"That's a lie," Gammick responded. "All of those conversations were made pursuant to a federal court order. I had a court order. They knew that. I told them that."

Mack's other lawyer, Scott Freeman, said they also want all communication between Mack and Gammick to be thrown out because Gammick knew Mack was being represented by lawyers but failed to advise him of his rights.

"What he did was unethical," Freeman said. "Any lawyer who knows a party is represented by a lawyer is prohibited from speaking with the person until that lawyer gives permission. It makes the hiring of a lawyer meaningless. Lawyers are hired to protect their clients whether he agrees with it or not."

Gammick said he was "not going to get into that one."

"All of that will get washed out later," he said.

The motions also ask the court to separate the two charges, murder and attempted murder, into two separate cases, that the case be moved out of the area and that items taken from Mack's home be excluded because detectives did not have a search warrant.

Arguments Continue Over Mack Divorce Settlement in Reno

A lawyer for the estate of Charla Mack says her estranged husband accused of killing her should be held to a verbal agreement he made regarding a divorce settlement.

During a hearing Monday in Reno, lawyer Egan Walker argued that Darren Mack should be ordered to pay the nearly $1 million dollar settlement to Charla Mack's estate.

But Mark Wray, Darren Mack's civil attorney, countered that the settlement agreement ordered by Washoe Family Court Judge Chuck Weller last year was never signed and is not legally binding.

Mack remains jailed while he awaits trial on charges of killing his estranged wife and shooting Weller through the window of his third-floor chambers. The judge survived.

Third Judicial Judge David Huff, who was assigned the divorce case after all Washoe County judges were removed, took the arguments under consideration.

Judge in Mack Civil Case Denies Motion to Recuse Himself

The judge assigned to hear a civil case against a man accused of shooting another judge says his law clerk's past relationship with the plaintiff does not warrant his recusal.

Annie Allison is the secretary for Washoe Family Court Judge Chuck Weller, who was shot through the window of his chambers in June. Allison was hit by shrapnel and suffered minor injuries.

She is suing the accused shooter, Darren Mack, who is also awaiting trial on charges of killing his estranged wife on the same day.

Mack's civil lawyer, Mark Wray, argued that Judge John Iroz should recuse himself from the case because his law clerk and Allison have known each other since high school and dated over the years.

Iroz rejected the arguments, saying both Allison and his clerk said that they haven't seen each other in seven years. The judge also noted that the outcome of the case will be up to a jury.

Wray says he'll take the issue to the Nevada Supreme Court.

Lawmakers consider bill prompted by Mack case
Nevada lawmakers Tuesday reviewed a bill to create rules guiding judges in alimony disputes, a measure prompted by the case of Reno businessman Darren Mack, charged with killing his wife and trying to murder the Reno judge handling his divorce case.

The Assembly Judiciary Committee also heard testimony on a bill stemming from a divorce case that led to a murder solicitation conviction in Southern Nevada. That bill would eliminate parental rights for anyone who is convicted of soliciting murder.

Assemblyman John Carpenter, R-Elko, said he decided to propose his Assembly Bill 52 after reading about Mack.

"Maybe we wouldn't have had such a terrible case" if the guidelines had been spelled out in state law, he said.

Mack reportedly was upset by how Washoe County Family Court Judge Chuck Weller was handling his divorce, and according to court documents was upset because his wife, Charla, 39, refused to agree that they accumulated no community property during their marriage.

In May 2005, Weller ordered Mack to pay $10,000 a month in temporary alimony payments to his wife. Mack filed for bankruptcy to avoid paying, according to court papers. Court filings showed that Mack earned more than $500,000 a year and had a net worth of $9.4 million.

Nevada law does not provide guidelines for how a judge determines alimony. Judges decide payments based on several precedent-

setting state Supreme Court decisions. Carpenter said it's unclear whether judges always follow the points outlined by case precedent.
