About me:
On May 15th, 2008 My Husband Luke Scarmazzo And Our Dear Friend Ricardo Montes Were Found Guilty For Operating A Medical Marijuana Dispensary Here In Modesto California. They Were Both Charged With Running A Continual Criminal Enterprise, Which Holds A Mandatory Minimum Of 20 Years To Life, Distrubution, Cultivation, And Manufacturing Of Marijuana, Which Holds A Mandatory Minium Of 5-10 Years. The Dispensary Was Called California Healthcare Collective. They Operated For Almost 2 Years. The Collective Was Legal Under California State Laws, And Had A Business License Through The City Of Modesto. The Collective Was Established Through Corporite Attorneys, Paid All City, State, And Federal Taxes. The Collective Had Receipts For Every Purchase, Made Daily Bank Deposits Into Bank Accounts, Had Accountants, As Well As Payroll For Their Employee's. This Was A Very Above The Board Business. No One Was Able To Enter The Dispensary Without The Proper Identification, And Doctor Recommendations, Everyone Was Verified.
I Sat Through Trial Everyday, The Prosecution Said "State Law Is Totally Irrelevant In This Case!" I Wanted To Say What!!! If State Law Had Not Permitted Them To Open A Dispensary They Would Not Of Have Done So!!! The Government Was Permitted To Shield The Jury As To Why They Did What They Did, And Not That They Just Sold Marijuana. They Were Not Able To Say "We Sold Medical Marijuana" Medical Marijuana Wasn't Even Allowed To Be Used In Court. It Was A Vert Unfair Trial, And If The Government Let In The Whole Truth, And The Real Facts, We Would Have Prevailed. The Jury Was Not Allowed To Know How Much Time They Were Facing As Well. This was another way for them to get a win.
The Government Hides The Truth!!! They Say That Medical Marijuana Is illegal, Yet They Provide And Have Been Providing 9 People, 4 Whom Are Alive Today, With Pre Rolled Medical Marijuana Joints Every Month.
. In 1978 The Federal Government Provided 9 People (Only 4 Are Alive Today) With Medical Marijuana After A Medical Necessity Defense Was Recognized In Court. This Recognition Created The Investigational New Drug Compassionate Access Program (Ind Program). This Program Was Closed To New Patients In 1992 Due To A Flood Of Aids Patients Who Were Interested In Being A Part Of Ind. The People Who Still Receive Medical Marijuana From Our Federal Government Are:
Irvin Rosenfeld Receiving 600 Pre Rolled Marijuana Joints Monthly Since 1982
George Mcmahon Receiving 320 Pre Rolled Marijuana Joints Monthly Since 1990
Elvy Musikka Receiving 320 Per Rolled Marijuana Joints Monthly Since 1988
Barbara Douglas Receiving 360 Pre Rolled Marijuana Joints Monthly Since 1991
The Federal Medical Marijuana Program Marked Its 30th Anniversary May 10th, 5 Days Before Luke And Ricardo Were Sentenced. The Same Government That Started This Program And Has Recognized Marijuana's Medical Affects, Is The Same Authority Who Sentenced Mr. Scarmazzo And Mr. Montes To 20 Mandator Minium Years In Federal Prison.
. In 2002, The 9th Circuit Court Appeals Decided To Uphold The Right Of Doctors To Recommend Marijuana To Their Patients, And Of The Patients To Receive That Recommendation.
This Is Such An Injust, Justice Has Been Tarnished, Luke And Ricardo Do Not Deserve To Go To Prison For 20 Years. We Need Supporters!!!
