On October 10, 2006, Supreme Court Justice Stevens issued the following statements in NO. 05-10671: --------------------------------------------------------- "Texas law provides that a "judgment is the written declaration of the court signed by the trial judge and entered of record showing the conviction or acquittal of the defendant." Tex. Code Crim. Proc. Ann.,Art. 42.01, §1 (Vernon 2006 Supp. Pamphlet) (emphasis added). ----------------------------------------------------------- "An order of deferred adjudication probation is not a conviction, and it is therefore not a "judgment" under Texas law." See Davis v. State, 968 S. W. 2d 368, 371 (Tex. Crim. App. 1998)." DEFERRED ADJUDICATION IN TEXAS IS NOT A CONVICTION; ********************************************************** ********************************************************** however, ignorance of the law has propagated falsehoods about deferred adjudication which must be addressed. The goal of the web site is to spear head efforts in promoting social justice by helping improve the privacy of individuals affected by Deferred Adjudication. ********************************************************** ********************************************************** Texas Penal Code on Deferred Adjudication says the following " a dismissal and discharge under this section may not be deemed a conviction for the purposes of disqualifications or disabilities imposed by law for conviction of an offense." *********************************************************** *********************************************************** We are seeking citizens in the Austin or Travis county area who have been negatively impacted by Deferred Adjudication in the state of Texas or knows someone who has. *********************************************************** *********************************************************** We are working with our legislatures to fix this ever growing problem. Every year over 80,000 Texas citizens accept a deferred adjudication contract with a district attorney. Up till now, the state of Texas has ignored the civil rights of those who have completed deferred adjudication by allowing the TEXAS WORKFORCE COMMISSION, TEXAS COMMISSION ON LICENSING AND REGULATION,APARTMENTS, LANDLORDS, PRIVATE EMPLOYERS, SCHOOLS, ETC, to use DEFERRED ADJUDICATION AGAINST SOMEONE BY REDEFINING IT AS A CONVICTION. THIS ACTION BY THE STATE OF TEXAS VIOLATES MANY CIVIL LIBERTIES AND RIGHTS OF TEXAS CITIZENS. ********************************************************** ********************************************************** DEFERRED ADJUDICATION IS NOT A CONVICTION AND SHOULD NEVER BE VIEWED AS SUCH!!! ********************************************************** ********************************************************** PLEASE HELP US FIGHT THIS ONGOING PROBLEM. THIS PROBLEM WILL NOT FIX ITSELF! WE MUST WORK WITH OUR TEXAS REPRESENTATIVES TO FIND A SOLUTION THAT WILL HELP THE STATE UPHOLD ITS SIDE OF THIS DEFERRED ADJUDICATION CONTRACT THAT IT SIGNED WITH OVER 2 MILLION TEXAS CITIZENS. TEXAS DEFERRED ADJUDICATION CAN NOT CONTINUE TO BE HELD AGAINST ANYONE BECAUSE THE LAW CLEARLY STATES THAT IT IS NOT A CONVICTION! PROTECTING THE CIVIL RIGHTS AND LIBERTIES OF EVERY TEXAS CITIZEN. EXPUNGING ALL RECORDS OF DEFERRED ADJUDICATION!!! HOLDING THE STATE OF TEXAS ACCOUNTABLE FOR THE CONTRACT OF DEFERRED ADJUDICATION THAT IT SIGNED WITH OVER 2 MILLION TEXAS CITIZENS. Texas Penal Code on Deferred Adjudication says the following " a dismissal and discharge under this section may not be deemed a conviction for the purposes of disqualifications or disabilities imposed by law for conviction of an offense." ********************************************************* ********************************************************* IF YOU WOULD LIKE TO VOLUNTEER TO FORCE THE STATE OF TEXAS TO UPHOLD ITS CONTRACT OF DEFERRED ADJUDICATION THAT IT SIGNED WITH OVER 2 MILLIONS CITIZENS, HAVE QUESTIONS, OR CONCERNS, PLEASE EMAIL US AT : AUSTINTAJLR@YAHOO.COM

Supreme Court Justice Stevens On Deferred Adjudication! On October 10, 2006, Supreme Court Justice Stephens issued the following statements in NO. 05-10671: "Indeed, reconciling the majority’s conclusion with AEDPA’s text is particularly difficult because Texas law provides that a “judgment is the written declaration of the court signed by the trial judge and entered of record showing the conviction or acquittal of the defendant.” Tex. Code Crim. Proc. Ann.,Art. 42.01, §1 (Vernon 2006 Supp. Pamphlet) (emphasis added). An order of deferred adjudication probation is not a conviction, and it is therefore not a “judgment” under Texas law. See Davis v. State, 968 S. W. 2d 368, 371 (Tex. Crim. App. 1998)." Justice Stevens goes on to cite Davis v. State, 986 S. W. 2d 368, 370 (Tex. Crim. App. 1998) At the end of that cite, it is stated: (“The whole point of [the deferred adjudication probation] statute is to avoid having to formally adjudicate the defendant’s guilt unless and until he demonstrates that he cannot abide by the terms of probation set by the court. If the defendant successfully completes his probation, his offense is essentially expunged”). By citing this referenced Texas case, Justice Stevens is, in effect, stamping his approval and affirmation on that ruling; in effect, Justice Stephens supports the notion that a successfully completed deferred adjudication is in fact, an expunged record! *********************************************************** WE WELCOME ANYONE AND EVERYONE WHO CARES ABOUT TEXAS!!! *********************************************************** IT DOESN'T MATTER WHAT RACE,NATIONALITY,SEX,RELIGION,OR AGE! *********************************************************** IT DOESN'T MATTER IF YOU ARE REPUBLICAN, DEMOCRAT,INDEPENDENT,GREEN PARTY, CONSERVATIVE, OR LIBERAL! *********************************************************** WE ARE ALL IN THIS GAME TOGETHER!!! *********************************************************** AND WE WELCOME EVERYONE AND ANYONE WHO HAS EVER HAD THE STATE OF TEXAS LIE TO THEM WITH DEFERRED ADJUDICATION!!! *********************************************************** WE HAVE TO FORCE THE STATE OF TEXAS TO UPHOLD ITS END OF THE BARGAIN. *********************************************************** TEXAS DEFERRED ADJUDICATION IS NOT A CONVICTION AND SHOULD NOT EVER BE USED AGAINST SOMEONE!!! *********************************************************** EMAIL US IF YOU WOULD LIKE TO VOLUNTEER TO HELP EXPUNGE THE DEFERRED ADJUDICATION RECORDS OF 2 MILLION PEOPLE!!!!!!!!!! *********************************************************** AUSTINTAJLR@YAHOO.COM

I just wanted to say thank you for all of your hard work. I have a drug charge from something someone dropped in my vehicle in which I was unaware. I accepted the terms of probation because, like so many others, I was lied to. I am a victim of circumstance and because of that I now have an extremely hard time finding a decent place to live and a good job. Thanks to you, your supporters, and your hard work we may soon see that change. Thank you.
