Supreme Court Justice Stevens On Deferred Adjudication!
On October 10, 2006, Supreme Court Justice Stephens issued the following statements in NO. 05-10671:
"Indeed, reconciling the majority’s conclusion with AEDPA’s text is particularly difficult because Texas
law provides that a “judgment is the written declaration of the court signed by the trial judge and entered
of record showing the conviction or acquittal of the defendant.” Tex. Code Crim. Proc. Ann.,Art. 42.01,
§1 (Vernon 2006 Supp. Pamphlet) (emphasis added). An order of deferred adjudication probation is not
a conviction, and it is therefore not a “judgment” under Texas law. See Davis v. State, 968 S. W. 2d
368, 371 (Tex. Crim. App. 1998)."
Justice Stevens goes on to cite Davis v. State, 986 S. W. 2d 368, 370 (Tex. Crim. App. 1998) At the end
of that cite, it is stated:
(“The whole point of [the deferred adjudication probation] statute is to avoid having to formally adjudicate the defendant’s
guilt unless and until he demonstrates that he cannot abide by the terms of probation set by the court. If the defendant
successfully completes his probation, his offense is essentially expunged”).
By citing this referenced Texas case, Justice Stevens is, in effect, stamping his approval and affirmation on that
ruling; in effect, Justice Stephens supports the notion that a successfully completed deferred adjudication is in fact,
an expunged record!

We are seeking citizens in the Austin or Travis county area who have been negatively impacted by Deferred Adjudication in the state of Texas or knows someone who has.

We are working with our legislatures to fix this ever growing problem. Every year over 80,000 Texas citizens accept a deferred adjudication contract with a district attorney. Up till now, the state of Texas has ignored the civil rights of those who have completed deferred adjudication by allowing the TEXAS WORKFORCE COMMISSION, TEXAS COMMISSION ON LICENSING AND REGULATION,APARTMENTS, LANDLORDS, PRIVATE EMPLOYERS, SCHOOLS, ETC, to use DEFERRED ADJUDICATION AGAINST SOMEONE BY REDEFINING IT AS A CONVICTION.
THIS ACTION BY THE STATE OF TEXAS VIOLATES MANY CIVIL LIBERTIES AND RIGHTS OF TEXAS CITIZENS.

I accepted the terms of probation because, like so many others, I was lied to. I am a victim of circumstance and because of that I now have an extremely hard time finding a decent place to live and a good job.
