I’ll always be Crackerjack no matter what, and be damned if I’m guilty. Claims against Crackerjack, roller derby skater, in trademarking her use of the word by Pepsico>Frito Lay>Cracker Jack: 1. Merely descriptive – crackerjack is how I play, not who I am 2. Likelihood of confusion – Crackerjack the roller derby skater can too easily be confused with Cracker Jack the popcorn treat. 3. Dilution – My use of Crackerjack will blur the connection between sweet and nutty popcorn and Cracker Jack; my use of Crackerjack will tarnish the image of Cracker Jack. 4. False Suggestion of Connection – I am using Crackerjack to suggest a connection with Cracker Jack, and people will believe it, and that will cause harm to Frito-Lay. Balderdash. Or should I say, Poppycock.
