An individual is complicit in a crime if he/she is aware of its occurrence, has the ability to report the crime, but fails to do so. As such the individual effectively allows criminals to carry out a crime despite easily being able to stop them, either directly or by contacting the authorities, thus making him/her a de-facto accessory to the crime rather than an innocent bystander.
How many others (particularly, businesses) can fit into the description as noted above?
Since Robert Metzgar was charged with theft by musician David Seale and thus produced case no. 2003-I-259 and in my personal experience Metzgar lied and deceived me by making false claims/assertions in writing and emails, there clearly exists an instance of a potential violation constituting false or negligent misrepresentation. The case noted herein is a factual case with proven facts.
False Pretense As Crime: People who deceive using present facts are more dangerous than those who deceive by false promises. At trial, the prosecution must show not only that the misrepresentation was false, but that the thief knew of the falsity.
