Dan	Oct 9 2009 5:28 PM According to the Section 1.07 of the Texas Penal Code (http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.1.htm#1.07), a "'Person' means an individual, corporation, or association." (Sec. 1.07.38). An "individual" (the term taken from the definition of "Person") "means a human being who is alive, including an unborn child at every stage of gestation from fertilization until birth." (Sec. 1.07.26). Chapter 19 of the Penal Code (http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.19.htm) deals with the crimes of criminal homicide. Section 19.02 plainly states that a person commits the offense of murder if he "intentionally or knowingly causes the death of an individual." I am not a lawyer, nor do I ever want to be a lawyer, but I can read plain English. When I look at the definition of an individual and the definition of the offense of murder, I can plainly see that performing an abortion in Texas would constitute murder. In that definition of individual, a 15-week-old fetus would have the same right to life as anyone reading this note. However, Section 19.06 (http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.19.htm#19.06) says that: "This chapter does not apply to the death of an unborn child if the conduct charged is: (1) conduct committed by the mother of the unborn child; (2) a lawful medical procedure performed by a physician or other licensed health care provider with the requisite consent, if the death of the unborn child was the intended result of the procedure; (3) a lawful medical procedure performed by a physician or other licensed health care provider with the requisite consent as part of an assisted reproduction as defined by Section 160.102, Family Code; or (4) the dispensation of a drug in accordance with law or administration of a drug prescribed in accordance with law." So, unborn children are defined as persons, and yet Texas law makes an exception as to the rig
