Plea Deal Drops Murder Charge Against Kerrigan By Matt Hawkins Marion Daily Republican Wed Jul 15, 2009, 09:32 AM CDT Marion, Ill. -
A last-minute deal Tuesday morning kept Herrin resident Peter Kerrigan from facing a jury. Kerrigan pleaded guilty to involuntary manslaughter for the December 2006 death of Brynden Gibson.
The Class 2 felony carries a possible extended term of up to 28 years in prison, but the state will seek a maximum sentence of 20 years.
Murder and aggravated battery charges were dropped.
According to the charge, Kerrigan "recklessly failed to obtain medical attention" for the 23-month-old Gibson.
"We got the best resolution we could to a long, drawn-out and emotionally-charged case," said assistant state's attorney Lisa Irvin. "We reached the negotiation after long, hard considerations with family and law enforcement. It was the best resolution for a man who let a baby lie in a bed five hours and die."
Gibson's family declined comment.
Lisa Irvin pieced together the events of Dec. 10, 2006, based on testimony that would've been given in a trial.
She said the child's babysitter was notified of something amiss by Rebecca Gibson, who is the victim's mother and was Kerrigan's wife at the time of the incident.
"She found Kerrigan pacing in the house, with the baby lying on the couch limp, barely breathing and unresponsive," Irvin said. "All Mr. Kerrigan could say was 'I'm sorry, I'm sorry. I'm going to jail.'"
According to Rebecca Gibson's likely testimony relayed by Irvin, Gibson left for work in the morning, then she received a call from Kerrigan. Kerrigan told her he was in the living rom when he heard a "thump" as the child apparently banged his head on the floor after a tumble from a chair.
Kerrigan then gave the child Tylenol and put him to bed. The child later wouldn't wake up and reportedly was making "wheezing sounds." <br/
