    * Medicare has stopped paying for an important treatment for patients with HIV infection... Extensive negotiations and appeals with Medicare representatives have not reversed their position...... Now, these patients and their doctor are fighting back in Federal Court.

    Urgent News!

    HIV patients are Continuing Their Fight for Medical Care into the U.S. Federal Court of Appeals.

    Update on the Medicare Fight………

    1999 – 2004 - Medicare tries to stop the use of IVIG (a treatment for recurrent infections) in patients with HIV. In spite of 3 audits against Dr. Nemechek, use is found to be “medically necessary”. Treatments are allowed to continue. Medicare documents indicate the audits were started because Medicare thought Dr. Nemechek was spending too much money!

    October 2004 – Medicare issues new rules that eliminate the use of IVIG for patients with recurrent infections secondary to HIV infection; rules only apply to Kansas, Nebraska, and N.W. Missouri.

    2006 – 2007 – Administrative Law Judge rules against patients without even holding a hearing to discuss this life threatening issue.

    June 30, 2008 – Federal Judge rules in favor of Medicare without allowing the case to be heard in court. The patients’ attorneys are surprised by the brevity and lack of analysis of the Judges order.

    September 14, 2008 – Patients file an appeal to the U.S. Federal Court of Appeals.
