UNITED STATES, IN CONGRESS ASSEMBLED, AND TO THE PRESIDENT OF THE OF
SENATE AND TO THE GOVERNOR OF THE 50 STATES AND THEIR RESPECTED
REPRESENTATIVES AND BODIES:
We the People of the United States of America hereby petition as follows:
WHEREAS, The Tenth Amendment to the Constitution of the United States specifically
provides that, "The powers not delegated to the United States by the Constitution, nor prohibited
by it to the States, are reserved to the States respectively, or to the people."; and
WHEREAS, The Tenth Amendment defines the total scope of federal power as being
those powers specifically granted to it by the Constitution of the United States and no more; and
WHEREAS, James Madison, "the father of the Constitution," said, "The powers
delegated to the federal government are few and defined. "; and
WHEREAS, The scope of power defined by the Tenth Amendment means that the federal
government was created by the states and the people specifically to be limited in its powers
relative to those of the various states; and
WHEREAS, Today, in 2009, the states and its people are demonstrably treated as
subordinates and servants of the federal government; and
WHEREAS, Stated in the Declaration of Independence, July 4 , 1776 “Governments are
instituted among men, deriving their just powers from the consent of the governed”; and
WHEREAS, Patrick Henry on June 5, 1778 said “Guard with jealous attention the public
liberty. Suspect every one who approaches that jewel. Unfortunately, nothing will preserve it but
downright force. Whenever you give up that force, you are inevitably ruined.”; and
WHEREAS, Today, in 2009, the Federal Government, the representatives of the People
of the United States are suspected of approaching and encroaching upon our liberties and rights
derived; and
WHEREAS James Monroe said “How prone all human institutions have been to decay;
how subject the best-formed and most wisely organized governments have been to lose their
check and totally dissolve; how difficult it has been for mankind, in all ages and countries, to
preserve their dearest rights and best privileges, impelled as it were by an irresistible fate of
despotism.”; and
WHEREAS, Today, in 2009, the Federal Government, the representatives of the People
of the United States including their states respectively are in decay due to despotism; and
WHEREAS, we submit this petition as an act to correct such despotism;
NOW THEREFORE, we the People of the United States of America respectfully resolve:
(1) That we the People of the United States of America hereby claim sovereignty
under the Tenth Amendment of the constitution of the United States of America over all powers
otherwise not enumerated and granted to the federal government by the Constitution of the
United States; and
(2) That this serve as a NOTICE and DEMAND to the federal government to
maintain the balance of powers where the Constitution of the United States of America
established it and to cease and desist, effective immediately, all mandates that are beyond the
scope of its constitutionally delegated powers.
