Anyone who fights for what they believe in. This case involves three children, where the mother has obtained many default orders without proper service to the father. These orders were issued by both the District and Superior Courts of Jefferson County, Washington and have caused an impermissible termination of the parent-child relationship of the father. Twice in a 5-year period, the District Court entered orders changing the children’s surname and also entered a nine-year no contact order against the father absent any prior history of domestic violence or abuse. The Superior Court refused to vacate these improper orders. The Court of Appeals affirmed the denial.
By the time the no contact order expires, the oldest child will be the age of majority. It is a clear egregious miscarriage of justice that has gone on in this case. Although the father’s parental rights have not been terminated altogether, he has been stripped of the right to have a relationship with his children. If all parents were able to manipulate the system the way this mother has, no parent would ever have access to their children after a divorce.
Kristie and Shawn were married on January 23, 1994. Kristie did not work the entire 6 years of their marriage. On November 2, 1998, Kristie told Shawn that she did not want to have a life with him any longer. Shortly thereafter, without notice to the father, Kristie fled the State of Washington, abducted their 4 children and moved to Iowa, which was over 2000 miles away. On May 28, 1999, Kristie obtained an Order for Relief from Domestic Abuse against Shawn while she was living in Iowa and he was living in Show Low, Arizona which prohibited him from having any contact with his little sons for a period of 1 year. This was done after Kristie told Shawn that she wanted to pursue a relationship with his childhood friend and former business associate.
Six months later, Kristie moved back to Washington. She filed for divorce on March 28, 2000. On the date of filing, she also filed a motion to serve Shawn by advertising in a local newspaper that she was divorcing him when she knew he lived in another state. The Superior Court Commissioner abused her discretion and violated state statutes when she granted the motion to serve Shawn by publication the following day. The divorce, parenting plan, and child support order for $965.25/mo., was entered on July 6, 2000, again by the same court Commissioner. In the child support worksheets, Kristie failed to disclose to the court that Shawn had children from a previous marriage and a child support order from another state or the fact that she was receiving child support for her oldest son. All of these factors should have been considered before the Washington Court assessed child support for their children.
About thirteen months later, on August 2, 2001, Kristie filed a motion to serve Shawn again by publication. The same Court Commissioner failed to follow WA law regarding service by publication and again granted an order to serve Shawn by publication the same day the motion was filed. Six days later, Kristie filed a petition to modify the parenting plan requesting the court remove all Shawn’s visitation with the children. On October 12, 2001, the Superior Court Judge (who is now deceased) entered an order of default modifying the parenting plan further granting all Kristie’s relief without her having to show any adequate cause to justify removing Shawn's visitation rights.
Five days later, Kristie filed a petition in District Court, without any notification to Shawn, to change the children’s surname. On October 26, 2001, the Pro-Tem District Court Judge (now deceased) entered an order changing the children’s surname from their father’s to their mother’s maiden name. On April 14, 2004, Kristie filed a petition in District Court seeking an emergency protection order. On May 24, 2004, the District Court Judge (new retired) entered an order of default restraining Shawn from his children until 2013.
August 2005, Kristie’s Louisiana attorney served Shawn with a Rule for Contempt for failure to pay child support. On September 12, 2005, a Caddo Parish District Court Judge found Shawn in contempt and sentenced him to 90-days in jail. He was taken to jail immediately from the courtroom. On September 14, 2005, Shawn was released from jail after paying $12,548.25 in child support. On September 16, 2005, Shawn appeared before the court and was purged from his 90-day sentence and ordered to stay current with child support. On January 6, 2006, Shawn was served with another Rule for Contempt through the Louisiana Court attempting to enforce the Washington child support order. Shawn did not appear for the March 21, 2006 trial. Therefore, the court entered a default order finding Shawn in contempt for being $706. behind on his child support payments and issued a bench warrant and ordered that Shawn would have to serve the remainder of his 90-day sentence because he was behind on paying child support. The warrant was entered into the NCIC computer.
On May 22, 2006, Shawn’s WA lawyer filed a Motion to Set Aside the Parenting Plan and Child Support Order. On August 4, 2006, Shawn’s lawyer filed a petition to modify the parenting plan. On August 23, 2006, Kristie filed a response in opposition to Shawn’s petition to modify parenting plan. A hearing was held on August 25, 2006 for a determination of adequate cause. The trial court declined to rule on the Shawn’s motion for an adequate cause determination.
On September 6, 2006, a hearing was held before the Jefferson County Superior Court Judge (now presiding). The motion to set aside the parenting plan and order of child support was dismissed with prejudice and the petition to modify the parenting plan was denied. Even though there was never any allegations or history of abuse, Shawn had no visitation provisions with the children and there was a 9-yr. court order restraining him from his children, the Court still failed to find that any adequate cause existed to modify the parenting plan allowing Shawn access to his children after being denied for 8 years by the children's mother. The Court further refused to hear anymore pleadings from Shawn until he addressed the Louisiana civil warrant.
Then two days later, Kristie filed a petition in the District Court, without notifying Shawn, to change the children’s surnames again. On September 11, 2006, the District Court Judge (now retired) entered an order changing the children’s surname to Kristie’s new husband’s last name.
Shawn filed an appeal to the Washington State Court of Appeals on October 19, 2006. On July 9, 2007, the Court of Appeals Commissioner filed a Ruling Affirming the trial court’s judgment. Shawn then filed a Motion to Modify the Appeal Court Commissioner’s Ruling on August 6, 2007. On September 25, 2007, the Chief Judge entered an Order Denying Motion to Modify. On October 25, 2007, Shawn filed an appeal with the Supreme Court of Washington. On June 3, 2008, the Washington State Supreme Court entered an Order Denying Shawn's Petition for Review.
What’s interesting about this case is that Kristie and her husband live in the small town of Port Townsend, they own a BBQ restaurant, her husband has lived there almost all his life and was just named the "2007 Business Leader of the Year". He’s also a member of several community organizations, like the Elks Club, Kiwanis Club, Habitat for Humanity, Rotary Club, President of the School Foundation Fund, a volunteer high school wrestling coach for PTHS. Why everyone in that community thinks he's just the greatest guy around. They even think Shawn's sons are Nick's children.
Both the District and Superior Court Judges are members of the local Elks and Kiwanis Clubs too. The former District Judge is the President of the Habitat for Humanity. Now get this, Kristie’s counsel is the former law partner of the Superior Court Judge who presides over their case. Not only that, Kristie’s attorney has given that same Judge her power-of-attorney. Talk about a conflict of interest! That Judge should no doubt recuse himself from any case that comes before him being litigated by his former law partner. How in the world could a non-resident possibly get a fair hearing or trial in a small town run by people who are actively involved in the same social networks, working closely together in their community organizations with the judges and court commissioners?

About me: Although I committed myself to marriage, the women I married did not. Have you ever awakened to a life that you just no longer understood? Where right is wrong and wrong is right, where black is white and white is grey? I wish I could erase my memory and start all over sometimes, it would be far better than to live watching another man living my life. I have three young sons, whom are now young men, and another who was my step-son, but a son still the same. Those children had their worlds changed forever by their mother and a man whom I can barely utter his name without being enraged.
A dozen years ago, I was a father to all of my sons. Their mother and I had a happy marriage and a promising life together. I think back to what really happened to make all of that change, to the details of how a woman who showed no signs of anything wrong, turned to the arms of my childhood friend and business associate. The events which have followed through the years since have been nothing short of evil and maniacal torture. Had it not been for divine intervention, I would not be able to withstand the relentless attacks of degradation and secret combinations designed solely to destroy me and any efforts made to be a father to my children or have a life for that matter.
I look at the grotesque pictures of the man who did this to my children and I all because he envied my life and the family I had growing up. The signs of his abuse are showing in the lengths he goes to keep my voice silent and my life minimized. Many who read this cannot believe it; they remember their two high school buddies as life friends, an unbreakable brotherhood they shared. I too have often tried to source the broken pieces and make sense of it all? The propagation of lies and stories concerning me and the relevant nature to their lives now is nothing short of a fictional novel of indiscretion on their part. They have told their tale so many years that they themselves believe it as if it were fact and truth unwavering. So convincing they have been that judges and court officials, and local authorities have taken their testimonies without trial as the truth and factual, allowing them to completely erase me from my children's world without contention.
This is America, where a court of law decides justice and what-is-what in a dispute. Tell me where the law was when my sons walked into a court room without my knowledge and had all their names changed, not once but twice? Tell me where the justice was when a Judge sat and refused my testimony and removed all my parental rights except that of financial support? And you tell me where our family courts were when my baby boy was left unsupervised and allowed access to gasoline that could and nearly did kill him? Be sure of this, if there is one shread of justice left in our court system, I will find it and have served upon those who have abused my children with lies and the denial of their real father. I won't stop, I won't rest, I will never quit until justice is done and wrongs are made right. This man my children refer to as 'dad' is a "cruel, heartless soul" for what he has and continues to do to my sons, and if I don't get justice, my sons will when they learn the truth! It is my hope that very soon our family court system, judges, parent evaluators, and alienators will finally recognize that parental alienation is a form of emotional child abuse that cannot be ignored any longer.
Who I'd like to meet: My three sons who I have not seen in 11 years; Addison, Ben & Kevin. I gave them life, named each of them and they were sealed to BOTH their parents. Eleven years ago I watched my three babies and wife be taken from me by a business associate who I thought was my friend. Lies and conspiracy were promoted in order to completely erase me from my children's world.
I have struggled to keep on the right road so that one day, when my sons are of age, they will meet me and know the truth as it has happened. I fight the hate and anger. I try to think of the end result, of the day I meet my sons and can attempt to be a father to them, but it is hard, they will be adults likely and have been brainwashed. Some know those who keep my children from me, and you have been told Lord only knows what... But next time you see my sons, look at them and remind their "fake" daddy, that he is not their father and never will be. They may have illegally changed my children's last name, but no one can change biology or the fact that I am their one and only true father. I will not go away nor will those who care for what is right. I love my sons and one day they will know all!

Larry H. Monahan
August 25, 1933 - December 13, 2008
Larry Monahan was born in Seattle, WA, the son of Terrence Monahan, of Port Townsend, WA. Larry was the nephew of life-long Port Townsend resident, Maxwell Loomis. Larry completed his education in Spokane, WA graduating from Gonzaga Preparatory School. Upon his graduation, Larry joined the U.S. Navy, following in his father's footsteps. Larry served on a submarine tender during the Korean War. After his enlistment in the Navy, Larry returned to civilian life and married Jolene Lenard. They were married 30 years and had five children. Larry and Jolene owned and operated The Country Cousin Restaurant, in Kent, WA. until the late 1960's, then Larry moved his family back to his home-town of Port Townsend. Larry and Jolene purchased a marine and boat business and operated Monahan's Marine Center until it was sold in 1980. Larry's children all graduated from Port Townsend High School. Larry spent the remainder of his life as a writer. He owned a small newspaper in Arizona in the 1990's and later returned to Port Townsend where he enjoyed writing and spending quiet times with family and friends. Larry's life came to an end on December 13th, after a long and couragious battle with cancer. Larry is survived by his five children, Patti Minish, of Port Townsend, Mike Monahan of North Carolina, Kathy Nishino of Edmonds, WA, Shawn Monahan of Idaho, and Tim Monahan of Colorado. Larry has 14 grandchildren and one great grandchild. Larry was a proud man and good father, and he will be missed by all of his children. Special thanks from the family to our sister Patti; she cared and attended to Dad's needs in his last years and to Rod Peirson for being his special friend and to all those with Hospice who were there at the end.
In a reasonable world, children deserve the right to judge their own feelings in family court. Sadly, the kids are just the pawn used by the parent that alienates for their own behalf. Thanks for being a friend and I wish you the best. Our kids need us.
