A COVENTRY nightclub has won its battle against officials who ordered the venue to turn down the music.
Carey's in Hertford Place, Butts, was victorious in its appeal against a noise abatement order served on it by Coventry City Council.
The order followed complaints by two residents living in the nearby Regency House, who claimed the noise levels from the club were unacceptable.
District Judge Ian Gillespie ruled the order should have been served on the developers and owners of Regency House, who were told the development should provide protection against existing noise from nearby clubs at the planning stage in 2003.
Those measures were never taken to a satisfactory level.
Judge Gillespie said: "The decision was taken to protect the residents, however, through negligence by planners, architects and developers, they have left the residents exposed to the full force of Carey's music.
"If there hadn't had been, I very much doubt the residents would have cause for complaint.
"The abatement notice should have been served on the developers of Regency House - that should have been the first step - only then should Carey's have been considered for an abatement notice."
Counsel for Carey's had argued during a two-day hearing that the club had been operating for more than 20 years and had not received complaints before.
The sound equipment has also remain untouched for the past 19 years.
Following the order, Carey's reduced the bass of their music by 30 per cent on Friday nights, which led to a decline in custom and forced the club to close on those nights.
Speaking after the hearing, club owner Tony Carey said: "I am pleased with the result.
"It was obvious from the start that the wrong people were in court. We shouldn't have been involved at all.
"For the last six months the club has been a horrible place to work.

About me:
I'm an old man in the pub world, but have been owned for the last 22 years by John Tighe. In this time I have seen births and deaths, marriages and divorces celebrated/commiserated, sports and charity events, meetings, teachers parties, hen parties, stag dos, and many many many different kinds of musical wonders. There are too many to name, but span from traditional Irish music, rock n roll, jazz, indie, reggae, electro, funk, folk, punk, drum n bass(very occasionally!), metal, soul and the odd bit of country (I'm hoping to have some live original ska music in BEAUTIFUL GARDEN in September 07....but we'll have to see because at the moment I'm not allowed music in the garden).
I've survived on the energy of these events and the people who have made them - it's kept me spirit alive, but now I'm under threat from forms of censorship and control that if successful, may see not only my untimely demise, but also cause a greater threat to the surrounding community...the leftfield, kooky, unpredictable Irish Quarter in Digbeth...home of artists, musicians and other interesting inhabitants and residents who have settled here and flourished.

Who I'd like to meet:
Other pubs and associations that are commited to expanding on the culture of their surrounding areas and communities.
People who believe that areas should evolve and develop in an integrative way, so that the original vibrancy and worthwhile traditions are not lost, but the area becomes even more eclectic and vibrant (I'd particularly like to meet some council officials who genuinely share this view too...).
I want to meet bands of different musical backgrounds and have them play for me. It's my bread and butter.
Please come and visit me ands my friends in DIGBETH! Please come and put on a gig, a BBQ, or some other kind of performance. All ideas welcome. Please come and be entertained by the wonderful and highly intelligent bar maids. I guarantee you won't be disappointed.
