NCAI, the Nation’s Largest Indian Organization, Condemns UC Berkeley on Ancestral Remains, Supports Tribal Coalition’s Position


National Congress of American Indians Resolution Rejects UCB’s Elimination of Repatriation Unit, Subordination of Native Religion to University Research


DENVER, Colorado, Nov. 28, 2007 – The Native American NAGPRA Coalition (NANC) today strongly endorsed the National Congress of American Indians’ (NCAI) resolution protesting UC Berkeley’s decision to eliminate its tribally approved NAGPRA unit, diminish tribal participation and influence in repatriation processes and declare a huge portion of the Phoebe Hearst Museum’s collection of ancestral remains and funerary objects “to be culturally unaffiliated and thus not subject to tribal repatriation and NAGPRA requirements.” The resolution, which passed without dissent at the NCAI Annual Convention in Denver, also states that the “needs of scientists and scientific values” at the Museum “must be subordinate to the religious freedom and human rights of American Indians...” The Museum’s recent reorganization has elevated research goals over Native American entitlements under the Native American Graves Protection and Repatriation Act (NAGPRA).

The text of the resolution is pasted below and the signed resolution is attached to this email.

Founded in 1944 in response to termination and assimilation policies forced upon the tribal governments by the United States, NCAI now has over 250 member tribes across the country. NCAI the largest and most venerable Native American organization in America, and is best positioned to monitor federal laws, policies and decisions that affect tribal government interests. In this capacity, the organization “strongly recommends that appropriate authorities immediately undertake a formal investigation of the Phoebe Hearst Museum…”

In August, the Native American NAGPRA Coalition asked UC Berkeley Chancellor Robert J. Birgeneau to stop the Museum reorganization and meet with NANC to discuss the past and future of NAGPRA at the Hearst Museum. NANC’s letter protested the complete and deliberate exclusion of tribal representatives from the reorganization decision process, the new organizational structure that subordinates Native American religious rights to the goals of science, and the failure of the University to adequately consult with tribes on the cultural affiliation of ancestral remains and sacred objects per the requirements of NAGPRA. The Chancellor ignored the Coalition’s request, dismissed the protest as the agitation of a “few disgruntled employees,” and referred all tribal NAGPRA inquiries to subordinates. In spite of a major and successful NANC-sponsored demonstration on the Berkeley campus in October, UC system chief Rory Hume subsequently ignored similar requests from the Coalition.

“Thus far, the attitude of University officials toward sovereign Indian tribes has been dismissive, discriminatory and paternalistic,” said Ted Howard, Shoshone-Paiute, NANC representative and member of the 30-tribe Great Basin NAGPRA Coalition. “Their primary concern has been to placate powerful scientists who are extremely hostile to NAGPRA and who want to keep our ancestors for the purposes of research. If UC administrators continue this policy and ignore an organization of the stature of the National Congress of American Indians, they may destroy any prospect of cooperative and positive relationships with tribes in the future. Native American ancestral remains belong to Native Americans, and we will not stop until our ancestors are repatriated and returned to our mother earth.”

Indians regard repatriation as a human rights issue. The right to control ancestral remains is a basic human entitlement that has been extended to almost every ethnic group in the United States except Native Americans. Throughout American history, scientists routinely pillaged Native American burials and shipped massive amounts of ancestral remains to museums for scientific study. “It is time to correct this fundamental injustice,” said Howard.

TITLE: Support for NAGPRA at the University of California - Berkeley

WHEREAS, we, the members of the National Congress of American Indians of the United States, invoking the divine blessing of the Creator upon our efforts and purposes, in order to preserve for ourselves and our descendants the inherent sovereign rights of our Indian nations, rights secured under Indian treaties and agreements with the United States, and all other rights and benefits to which we are entitled under the laws and Constitution of the United States, to enlighten the publictoward a better understanding of the Indian people, to preserve Indian cultural values,and otherwise promote the health, safety and welfare of the Indian people, do herebyestablish and submit the following resolution; and

WHEREAS, the National Congress of American Indians (NCAI) wasestablished in 1944 and is the oldest and largest national organization of AmericanIndian and Alaska Native tribal governments; and

WHEREAS, the Chancellor of the University of California at Berkeley has,without properly consulting with appropriate American Indian tribes, decided todiscontinue the tribally approved NAGPRA unit dedicated to discharging Universityresponsibilities to tribes under federal NAGPRA laws and regulations and has movedto place the NAGPRA program within other activities of the Phoebe Hearst Museumof Anthropology, thereby diminishing tribal participation and influence in the existingNAGPRA unit; and

WHEREAS, the needs of scientists and the scientific values of the PhoebeHearst Museum of Anthropology’s collection of skeletal material and other sacredobjects must be subordinate to the religious freedom and human rights of AmericanIndians whose ancestors and sacred cultural properties are housed in said collections; and

WHEREAS, The Great Basin Intertribal NAGPRA Coalition (30 tribes) andother tribes have vigorously opposed this action by the University of California atBerkeley; and

WHEREAS, as much as fifty percent (minimum of 5,675 biologicalindividuals (50%) and 69,028 Associated Funerary Objects) of the Phoebe HearstMuseum of Anthropology’s collections have been incorrectly declared to be culturallyunaffiliated and thus not subject to tribal repatriation and NAGPRA requirements; and

WHEREAS, the decision by the Chancellor of the University of California atBerkeley places sacred American Indian skeletal remains and artifacts into the handsof University employees who are inadequately trained in the care and preservation ofsuch sacred items according to tribal customs and traditions; and

WHEREAS, the NCAI quotes Section C of NAGPRA; Museum means any institution, including institutions of higher learning – colleges, universities etc. or state or local government agencies that possess or has control over Native American collections (human remains or cultural items) and receives funds through grant, loan, contract or other arrangement by which Federal money or assistance is given to a museum for any purpose, are bound by the stipulations of NAGPRA; and

WHEREAS, Section 5 of NAGPRA says, “In general” each Federal agency and each museum which has possession or control over holdings or collections of Native American human remains and associated funerary objects shall compile an inventory of such items and, to the extent possible based on information possessed by such museum or federal agency, identify the geographical and cultural affiliation of such item. Requirements (1) the inventories and identification required under subsection (a) shall be (A) competed in consultation with tribal governments and Native Hawaiian organization officials and traditional religious leaders.

NOW THEREFORE BE IT RESOLVED, that the NCAI does hereby stronglyrecommend that appropriate authorities immediately undertake a formal investigation of the Phoebe Hearst Museum of Anthropology of the University of California at Berkeley, to determine what provisions of NAGPRA and related federal requirements have been overlooked by the actions and inactions of the Phoebe Hearst Museum and the University of California, Berkeley.

BE IT FURTHER RESOLVED, that this resolution shall be the policy of NCAI until it is withdrawn or modified by subsequent resolution.

The foregoing resolution was adopted by the General Assembly at the 2007 Annual Session of the National Congress of American Indians, held at the Hyatt Regency Denver at the Colorado Convention Center in Denver, Colorado on November 11-16, 2007, with a quorum present.

We the undersigned come together before you to request the immediate and unconditional release of Mr. Leonard Peltier from his unjust imprisonment.

Mr. Peltier was convicted for the June 26, 1975 murders of 2 FBI agents on the Pine Ridge Indian Reservation. There were 4 defendants originally charged before the Grand Jury. Two of the defendants were tried before the court and found Not Guilty by reason of self-defense.

Charges were dropped on the 3rd defendant. Mr. Peltier was tried after a change of venue to North Dakota. In this trial Mr. Peltier wasn't able to put up a self-defense argument. Any evidence that could have proven Mr. Peltier's innocence was not allowed in his trial or if it was allowed it was not allowed in front of the jury. Witness testimony wildly diverged between Grand Jury testimony and trial testimony; further, several of the witnesses recanted their testimony after the trial, claiming perjured testimony because of threats from the FBI. Despite testimony, prosecuting attorneys have stated on several occasions that they don't know who shot the agents that day.

The FBI coerced Myrtle Poor Bear into signing three mutually exclusive affidavits in order to extradite Mr. Peltier from Canada. In Mr. Peltier's trial Ms. Poor Bear testified that she never knew Mr. Peltier, that she had never seen Mr. Peltier prior to the trial. She testified that she signed the affidavits as a result of intimidation by agents interviewing her. The jury never heard her testimony, despite the fact she had originally been scheduled as a government witness, her testimony was excluded on the basis of her "incompetence".

A few FBI officials and/or agents have launched campaigns to publicly proclaim the guilt of Mr. Peltier. Thus perpetuating the original cover up through dissemination of misinformation in editorials, web sites and full page newspaper ads in what is seen as an effort to discredit the common sense and creditability of many national leaders and their organizations. These leaders have studied the case in-depth for over thirty-three years since the reign of terror on the Pine Ridge reservation and areas supposedly under the protection of this county.

Mr. President and elected officials of all people, we ask that you no longer ignore the voices of the tens of millions of signatures and letters of the last thirty three years, and the results of the most recent polls in favor of his immediate release. We ask all politicians and officials to support true justice. Honor the voices of your constituents. Call for immediate unconditional executive clemency for Mr. Peltier or parole under the 30 year law.

They worked for migrant wages in order to help their family of twelve children and so they could afford the musical instruments they desperately wanted and needed. These boys were blessed with talent, which couldn’t be denied…that talent was music. Patrick and Lolly grew, worked and learned together while yet in their teens, they backed the likes of Odetta and John Lee Hooker. They began to write music, always with the dream to have their own group to perform their original material. Eventually, their songs were recorded by Aretha Franklin, The Righteous Brothers and Bobbie Gentry. By the early 1970’s they had built a local California following and were signed to a five year contract with CBS/Epic. They made the charts with their first hit, “Maggie” and sold three million copies of their LP, “Witch Queen of New Orleans”. Their single, “Come and Get Your Love”, charted with Billboard and Cashbox for twenty-two weeks holding at #1 for fourteen weeks. The 1980’s signaled a time-out for Redbone. It was a time to become students of the spiritual elders of their tribe. A time to direct this special energy into developing new instrumental techniques and writing new material. In the 90’s Redbone came out with an album on RCA, which they recorded 10 songs called “Cycles”. After that they went to Avenue Records which is Warner Bros. And recorded “Redbone Live”. Pat Vegas still continues to be the heart and soul of Redbone writing the music with brother Lolly (who had a stroke and no longer tours with the band), singing and playing lead guitar. ( pronounced Busher ) is a Cherokee singer-songwriter who was taught from the beginning of his memory the stories, language and legends of his people. His songs are intended to teach, heal and bring an awareness to everyone who hears them. He sings about topics that are important to him and others in Indian Country. From the desecration of sacred sites, to Cherokee legends, to the sometimes seemingly Invisible Indian, there's a passionate quality throughout. Most of our archival footage is preserved on unedited outtakes and trims from 16mm local newsfilm. Researchers may only view this and other film & video material on pre-ordered screener copies due to long-term preservation issues. There will be no access granted to original film and video elements for viewing purposes.

This collection consists of local Emmy Award winning programs (1974-2005) presented by the Northern California Chapter of the National Academy of Television Arts and Sciences. Access to Emmy footage is available on a limited basis and will depend upon the condition of original U-matic and Betacam SP video formats on which it was recorded. Copyright is held by the individual station/production company which produced each award-winner.
Local Emmy award winners were donated to the archive by the National Academy of Television Arts and Sciences, Northern California Chapter.

Willie L. Brown, Jr. collection

The Willie L. Brown, Jr. collection consists of approximately 1500 news stories, press conferences, documentaries and other moving image material that relates to the political career of SF State alumnus Willie Brown as California State Assemblyman, Speaker and Mayor of San Francisco between 1972-2004. The footage is preserved on numerous video formats and was donated to the university as part of an initiative to establish the Willie L. Brown, Jr. Leadership Center. Copyright is held by various television stations and production companies.
It should be noted that we have other archival footage featuring Willie Brown in our local newsfilm collection that covers the period from 1966-1979.

Rob and Liz were driving home from Tacoma General Hospital, after Liz was released from giving birth to their son Robert Kyle Coos XaXa Satiacum born February 22nd. The driver was traveling at high speed down North Pearl Street and continued to drive after slamming into Rob and Liz who were crossing through a green light at 6th Ave. The driver was arrested later that night. He was charged with vehicular assault and was arraigned with a $25,000 bail. Elizabeth’s extensive injuries required she be taken to Harbor View Hospital in Seattle. Her neck and back were broken in multiple places. After nine hours of surgery, came the hopeful news from the surgeon that she would be able to walk. Liz will need several more surgeries and underwent a second surgery, on her neck injuries, on Thursday March 8th. She will also need extensive rehabilitation as part of the healing process. Thankfully, during the accident, their newborn baby was still in the intermediate care unit at Tacoma General. Robert Kyle was born 5 weeks early but still was a healthy 6 pounds. The baby was released Saturday March 2nd, and is being cared for by Grandma SuZan. The trial has been now changed to a date for the defendant to enter an agreed arraignment with the County Prosecutors to less charges, and enter a guilty plea, enabling him to receive less time of incarceration. The County Prosecutor's Office has recommended 15 months, and with time served credited, and the possibility of early release for good behavior, it's very possible the defendant could be released sometime towards the end of this summer. Presently, Elizabeth Sneatlum (Satiacum) is continuing to battle for a full recovery, and has yet to hold her new born son, Robert Jr. She's been fighting diligently to regain her life back and to someday soon, get out of her body brace and off her back, so she may be able to join, and perhaps even skipper her family's Canoe TaTa KwiK, in this year's Canoe Journey to Lummi, later this summer. Since the accident, we have been told by the prosecution and our attorney, that the State would aggressively pursue justice on our behalf, by proverbially "throwing the Book at 'em"; whereas, it appears they have chosen instead, to throw the "pamphlet" at him . Once again, we feel victimized and insulted by our elected officials and the justice system itself. We felt as though this could have become a platform of which to profess the dangers of drugs and alcohol use, and perhaps start some sort of legislation to make the State express exactly what side of the issue they stand on. As the controlling State agency, I believe the "organization" is sending mixed signals. "Friends Don't Let Friends Drive Drunk", "Drink Responsible", "Know When to Say When", "Drive Hammered, Get Nailed" etc. Just how many tax dollars have been spent on this hollow effort? And for what? As many cross's and alters have been set up along the highways, as there are the signs that are posted, and read, "Don't Drink and Drive" In memory of...How many more lives must be lost or devastated by the State condoning the distribution of this "controlled" substance? On each bottle sold, it is stamped W.S.L.C.B. Perhaps I should seek financial relief from them for the mountain of medical bills that have been stacking up, and monetary relief for suffering Mentally, Emotionally, Physically and Spiritually. As a Control Board, they should control their product. No matter how low you lower the Blood Alcohol Limit, you will always have people exceed the limit, perhaps "0" Tolerance is the obvious answer looking us right in the face, but perhaps, those that make the laws are equally guilty, and would have to take a good look at themselves. Either way, if you are going to be the one responsible for distributing the booze, then be responsible and cover the cost of your damage. If you want to really end this devastation, then end it. Perhaps the monies saved from not publishing the contradictive signs and propaganda about the dangers of drinking too much or the horrors of going to jail, could be better spent on being distributed to the damages their product creates! I am sending this message out as an open invitation to those sensible and people of integrity, to come and support Elizabeth, myself and family this Wednesday morning, by show up and offering us your support and showing the court the "ripple" effect of one person's action's. James Main, Sr., of the White Clay Nation died peacefully in his sleep at approximately 4:30 a.m. on January 29, 2009. His hard-fought battle with End-Stage Congestive Heart Failure over the past several years finally took its toll about two weeks ago. Like a true warrior, he did not go down easily, but went with honor and dignity. To the end, he maintained his humor, making those around him laugh…and cry as he used his dwindling strength to sing, talk Indian, pray, and tell of old times. Always at the center of his heart and spirit was the survival of the Red Nations.. It is an overwhelmingly sad day for his loved ones here on earth, but truly a victorious day for a warrior who is so deserving of the peace, love, and acceptance he will meet as all our relatives take him to his rightful place in the spirit world, known as the "Big Sands" to the White Clay people. As many of you may remember Jim Main, he was a steadfast and unrelenting warrior for Indigenous Peoples and especially for our homelands and sacred sites. In fact, his words and guidance helped inform our Sacred Sites Protection Campaign – including our memorable person Sacred Earth Summit in 2001 in Seattle, WA, and again, in 2002 in San Diego, CA. A member of the White Clay Society, Jim was a treasured leader to Seventh Generation Fund for many years. He will be sorely missed by our organization. We trusted Jim. We were honored when he attended our convenings and shared his great wisdom, wit, and generous spirit. He taught us through his conduct and his dedication. We looked to him often to help us. And, he was always generous. Jim was a true and consistent warrior, to be sure. And, as such, he was also a gracious, kind, thoughtful and honorable leader that set for us a clear pathway of how to continue work on behalf of our respective peoples. Jim would be so pleased to know of recent sacred sites victories in places like Panhe in California, and just a couple of days ago in Zuni, New Mexico. It would have been great to march with him in Redding, in the struggle to protect Hatchet Mountain (Pit River Country) from (so-called green) windmills that will damage a sacred area, and severely impact golden and bald eagle habitat. He knows, where he is now in the other world, that we will continue the good fight for our peoples. Today, in mourning, and reflecting on how much we have learned from Jim Main Sr., we carry forward – heavy hearted but as determined as ever to strive, to fight, to honor our ancestors, as he did. Sr., was asked to build a Life Renewal “Sweat Lodge” for the Lakota dancing there and also erect a couple Tipi’s. Greg was a Statesman of the Ihanktunwan DaNakota Nation, representing many nations at the United Nations in New York City and traveling extensively throughout Grand Mother Earth educating the world’s people regarding Indigenous Treaty and Human Rights. Greg was also a Spiritual Advisor, putting people on the hill to Fast, running Sun Dances, and performing Life Renewal Lodge ceremonies for many nations and peoples throughout his lifetime. He was also a Master Craftsman and musician, teaching his children how to play instruments so they could form the now famous soul rock band “Indigenous.” At the Wind Cave Sun Dance, Greg asked me if I would travel to see his friend, James “Jim” Main, Sr.’s home in Big Warm, Montana on the Gros Ventre Fort Belknap Indian Reservation and cut Tipi Poles for our Sun Dance Tipi’s. We had talked about Greg’s friend, Jim Main, previously (I had never met him) and that Jim had offered generously for us to come up and cut and take home as many Tipi Poles as we wanted. So I said ‘yes’ and off I went, hitchhiking to north central Montana to Jim Main’s place. Greg gave me a ride to the northwest end of Rapid City where I started my ‘journey.’ I got a ride to Gillette, Wyoming and had to walk from one end of town to the other along the interstate, when the clouds came over and it seemed as though it was going to snow – all I had for a jacket was a flannel shirt, as it was the first few days of August. It was late in the afternoon and I began to look to the side of the road where there was a group of trees and tall grass I thought would help me survive the night. Then I decided to take out a cigarette and offer it to the Sky and Earth and not one minute later, a small car pulled right over and the guy offered me a ride. I got in the car and the guy had a car phone! So I called the Black Hills Alliance office where I had worked and asked a friend there to contact his friends in Sheridan, Wyoming to see if I could stay the night there with them, if I made it that far. He said he would find out and call me back on the car phone. Just as we were getting to Buffalo, Wyoming, and exiting on the off ramp, where my ride had to turn off, the phone rang! My friend gave me the address and phone number of the people in Sheridan and said if I could make it I was welcome to stay there. I walked a half a mile and another car picked me up and took me right up to the house in Sheridan. I spent the night there with those people and the next day a friend of theirs was heading to Lame Deer, Montana on the Cheyenne Indian Reservation to attend a Sun Dance there. Even though Lame Deer was back east a ways, I decided to catch a ride over there and see if anyone was headed to north central Montana. I attended the Cheyenne Sun Dance for a while and asked around, but nobody was headed that way, so I got on the highway to hitchhike to Billings. A young Cheyenne man about my age picked me up. His name was “Big Back.” He took me to his house that was located right along the highway. When we got in his home, he had two sisters that were beautiful – but I had to press forth and get those poles, I kept telling myself. They fed me – so I knew they could cook – but I had to go to Jim Mains to get those poles! I always wonder what happened to the Big Back girls. Anyway. So I got a ride to the Crow Reservation with Big Back and a Mexican family picked me up and took me into Billings, where my father’s co-worker’s brother lived (I had been there years before). It was late in the afternoon, so I called my Dad and asked him to get hold of another one of his friends who lived there, a woman named Bernie something, so I could possibly stay with her – as I could not get hold of the other number. My Dad looked up the name in Billings with the first name initial and called, but it was a man. My Dad explained the situation and the guy offered to help out – that I could stay with him. My Dad called and I said ‘yeah.’ I was getting ready to go the Indian bar and go home with someone from there, so this stranger option with a similar phone book name seemed a lot better and safer. The guy was late picking me up – his car wouldn’t start so he was on a motorcycle, and I asked if we could drive by the house up on the hill overlooking billings where the number wasn’t working, so we rode up there and the guy was home! My Dad’s secretary had given me the wrong number, two numbers were switched. So I stayed at our friend’s place overnight and that’s where I got one of my Indian names. The guy had a slingshot on his porch so I grabbed it and put a pebble in it and turned around and just innocently shot it toward the outdoor security yard light and it hit the light and knocked it out. I got a ride to the north edge of Billings the next morning and got a ride with a young guy who had two fishing poles in the back. He wanted to stop at the Missouri River to fish, I said ‘sure’ so we pulled over, got out, went down to the river and immediately got dive-bombed by giant mosquitoes who did not land and rub their hands together – but came in stinger first and asked questions later. Well I don’t know if they asked questions alter or not because we ran back to the car as fast as we could. Never get out of the car in the middle of Montana near the Missouri River in early August. Although the Jim Main Ranch was 25 miles west off the highway, the young kid gave me a ride clear over there to Big Warm and dropped me off at the dirt driveway leading the half mile up to Jim Main’s house. Jim’s son and grandson happened to be riding horseback right there, so I told them who I was and what was going on and he told me to hop on – so the last leg of my journey was on Jim’s grandson’s horse right up to the front porch. I was always so lucky hitchhiking. So I got to finally meet Jim Main. Greg always praised the man, so I knew if Greg thought highly of him, he must have been an important person. Greg had the same type of respect and admiration for a great Indigenous man from Oklahoma named Phillip Deer and an Oglala man from Pine Ridge named Mathew King. Jim told me to relax and enjoy the place, that we would postpone cutting poles for a few days as there were activities going like the annual Pow-wow and hunting excursions. I got to meet his wife, children, and grandkids and got to hang out with and know Jim Main. Their home was like a paradise – I probably called in “Jim Main’s Paradise” to him, as he had been to the famed “Crow Dog’s Paradise” in Grass Mountain, Rosebud and everyone in the American Indian Movement (AIM) knew that place. He had many acres of land just under the Little Rockies Mountain Range and there was even a warm springs just above his house. He explained that we were on the same Treaty – the 1851Treaty of Fort Laramie, with his Gros Ventre Nation, and that we were always allies because of this. He would always tell me his family and nation stories about the Treaty and about Indigenous life. I began to understand why my cousin Greg so highly revered this man. He had over 75 really nice Horses. Once he wanted to ride so we went out and cornered the herd and he picked out the nicest, biggest, strongest buckskin and lasso-ed it. He really looked good on that Horse, with his cowboy hat on and his superior presence. Once they corralled some wild Horses and the corral they build was so huge, the animals looked like little miniature ponies running around in circles in there. We attended their Pow-wow and in the Men’s’ Fancy Dance contest category there were no contestants, with the first place prize being $400. We searched high and wide for an outfit for me but could not come up with any bustles so we had to let the $400 go. I went hunting with Jim’s son and grandson and we only seen an Elk, because I walked through a coolie thicket and scared it out and it just stood there, eyes looking right through me from about 75 feet away before I shot it in the heart area. As it dropped to its knees, Jim’s son shot where the head was just a split second sooner and the dirt flew up on the hill behind. That fast the Elk jumped up and sprang over the hill and as I started the chase, a huge thorn over an inch long went right into my shin. I had to stop and give Jim’s son my gun as he had run out and I had one left. It was evening so we got up the next day to try to find the Elk but it was only slightly injured and even if it was shot right in the heart, Jim told me they are so powerful, they can still run miles just on spirit alone. We did get a Deer. Jim wounded it and when it came around the corner where I was in hiding waiting for it I shot it in the heart with a pistol Jim had given me from his glove box. Jim’s son came and finished the Deer off by hitting it over the head with the butt of his rifle. I didn’t know I shot the Deer until the boys gutted it and found the pistol bullet in the heart (luck). We eventually went up the mountain and cut 175 Tipi Poles – the best kind, Lodge Pole Pine. Jim showed me how to tell Lodge Poles by the two needles instead of three that are on other Pines. On the way up, Jim showed me the destruction that the gold mining was doing and the harm to the Earth and contamination to the water they were fighting. We cleaned the bark off (“skinned”) the poles and prepared 93 poles for the trip back to Marty, South Dakota where Greg lived on the Yankton Sioux Reservation in southeast South Dakota. Greg was going to bring up a pickup truck to haul the poles back once we were ready. Cleaning the Tipi poles was a tough job and should be required for all boys so that they can reach manhood. My cousin came up with a half ton, regular old Ford pickup and made an ingenious rack to hold the poles out of Pine, but it was not strong enough to hold that many poles – so Jim gave us a stock rack to use. The poles fit perfectly between the metal bars two per row and off we went with the truck nearly busting its springs. I think we may have invented the “low rider” vehicles at this time, but do not know for sure if anyone from California seen us traveling along the roads between Montana and South Dakota. The springs held and we made it back to the Sun Dance grounds where we immediately broke out in a sweat from the high humidity of Marty. When we unloaded the poles, we counted 102 – but we had counted 93 at least three times and there was no way anyone could have thrown on nine more poles! I seen Jim Main a few more times over the years from then to now and had just heard he passed away on January 29, 2009. I immediately called his daughter and left a message on her phone, telling her I had heard of her Father’s passing and because the funeral was on the day that I heard and was unable to attend (February 1st), I wanted to let her know that I knew her Father as a great man and that we loved him and his family. Ranchers in north-central Montana often get along well with Indian cowboys. However, the treatment of Indians by the Montana Justice System has not improved its treatment of Indian people. "We've got a long way to go with the Justice system. I'd like to see a handful of radical attorneys come over here and shake this place up, attack the system," Main said. Main, known internationally as a voice for Indigenous Peoples, now in poor health following open-heart surgery, has a personal view of the state system. James Sr. laughs remembering how Bill Means said Jim Jr. should be a comedian because of his impersonations of John Wayne and others. Jim Jr. was the caregiver of his mother, Vernie White Cow Main, who lives on the homesite where she was born on Big Warm Creek on the Fort Belknap Nation. James Sr. said, "Jim took care of her. He almost had to be a nurse for six months. He trained himself to take care of her." James Sr. spent his life traveling for Indigenous rights, helping those who needed him. "I decided to do some good," he said of his decision to live a life in service to humankind. "I learned a lot about different people and different cultures. I never knew there were other Indians in California. I thought John Wayne got them all," James Sr. joked. "It's good to travel, travel around." Seated at home in the community of his childhood at Hays, James Sr. is surrounded by memories and the passing of time. "I don't know how long I'm going to last. I have got a lot of people praying for me. These Mayan Indians went up on a pyramid in Guatemala. It must have been a very powerful ceremony. I knew; it was in my mind." On his living room wall, there is a huge poster of a Gros Ventre man. It reads, "Sits on High, EK-GIB-TSA-ATSKE, of the White Clay People A'AH'NI NIN." James Sr. looks at the poster and says, "He did what they wanted him to do, settle down. Then, they took his land." Speaking about those who took the land here, rich in gold, water and forests, he says, "They make a fortune and they die." These days, James Sr. teaches his grandsons the philosophy that he has lived by. It is the philosophy of pride, self-esteem and honoring the culture. "Go back to your old ways, traditions and culture. That is what I teach my grandsons. Try to get the language back," he adds. There are only a handful of speakers left. James Sr. remembers the harsh years at St. Paul's Mission School. During second grade, when the children went to pray during Christmas mass, the nuns told them Santa Claus would come if they had been good. If not, there would be willow switches waiting. When they returned, they expected presents and instead found a stack of willow switches. There was also writing on the blackboard. "I recognized the writing. It was a priest's, telling us how bad we were." The little children were often beaten. James Sr. remembers, "They would slap us around for nothing." Remembering his father Tom Main, James Sr. said, "He was a humanitarian, a real leader. He did things for nothing. He could have amassed a fortune, but he didn't." James Sr. said Tom Main served as an interpreter at a time when few White Clay People spoke English. Tom served on the executive committee of the National Congress of American Indians. "I learned a lot from him, he was honest to a fault," Jim Sr. said of his father. "We had a pretty rough upbringing, we were poor and we had to haul water a long way. We burned wood, so we had to saw wood. My mother used to wash on Saturdays, all we did all day long was haul water." James Sr. grew up with three brothers and four sisters. Today, all of his brothers are living and the oldest is 86. He served in the Air Force in Japan and was there when the Korean War began in 1950. James Sr. also worked in the copper mines for 15 years. "That's where there was never racism, a melting pot." The happiest days of his life were spent during his high school years. "We rode horseback, we rode bucking horses; there were lots of wild horses. We had powwows during the holidays, I really enjoyed those. We had bone games, hand games, we would sing songs and have a guessing game. We tried to guess whose hand the bone was in." The men and women played each other. Kumeyaay have similar games, he said. Preparing for South Dakota Winter- WOLE needs your help! ===================================================== Greetings, I am speaking to you about a small local non-profit charitable organization based in Sterling, Ks that has been in business 6 years. We provide clothing, household goods and other needs to those living in poverty conditions in the central states. We also provided for the needs of local residents who have lost their homes as a result of fires or other natural disaters. We make regular trips to the Rosebud Indian Reservation in South Central South Dakota, providing the same services to the Native Americans residing in sub-poverty conditions. My name is J. During this time of social and economic upheaval in our country, donations have dropped extremely low, making it difficult to help others. While many are sympathetic to the needs and misfortunes of others, it is often hard to comprehend the extent of the difficulties some people on Indian Reservations can face. With unemployment on the reservations reaching as high as 85%, and 45% of the children living below the governmental poverty standards and a life expectancy of only 45 years, it is clear to see that America is not always a place of liberty and justice for all. While some tribes seem to be thriving with their casinos, it's important to realize that very little of that money ever reaches the people who are most in need. We are used to seeing the faces of poverty overseas, but in fact, there are many faces right here at home that can use our help. The poverty on these reservations is so severe many can not afford heat in the winter, or warm coats and blankets. Many don't have electricity or a telephone, things we take for granted. The lack of funding has created an absence or lack of adequate prevention and intervention programs throughout Indian Country. Culturally, American Indian people believe that children are both sacred and the hope of the future. The federal government, which promised in treaties to provide for Native Americans, spends less than half as much per tribal member as it does for programs covering other Americans. Housing must be paid for, which goes against the stipulations in the treaties, HUD is responsible for this housing. Why do these people have to pay to live in sub-standard housing, and where is the money going? Certaintly not into repairs or to provide adequite housing for the many homeless that wander about the reserve. While it is not possible to "fix" all the problems within the Indian communities, it is possible to implement programs that help feed the elders and children, provide heat in the cold winters. Web of Life Enterprises seeks to bring some comfort and help to those who are suffering on the reservations as well as those in immediate need. We strive to end the hardships that some people have faced, especially the children, and I am calling on you for your help and assistance in furthering our goals. Money, goods and services are all required to bring change, to providing better housing, decent food, warm clothing and blankets, and snow boots and coats for children who sometimes have to walk to the nearest schools or community centers for meals. In a place where winter seems to begin just after it has ended, contibutions of money, goods or services that are so hard to come by in these remote areas, will not only alleviate discomfort, but can also provide the means for people on these reservations to work towards bettering the future for the children. On the Northeastern edge of the Black Hills, just a few miles from the small town of Sturgis, off Highway 34, lies one of the most sacred mountains to the Plains Indians from the United States and Canada. Up to 60 different tribes traveled to Bear Butte to fast and pray. Separated by about 8 miles of prairie from the greater Black Hills, which are also considered sacred by these same nations of people, Bear Butte looks like a sleeping bear lying on its side with its head pointed toward the northeast. Geologists call Bear Butte a laccolith, or a bubble of magma that did not become a complete volcano. All the tribes of the Sioux people: Lakota, Dakota, and Nakota, came to Bear Butte to pray. The months of May, June, and July will see families camped at the base while a relative is standing on the side of the mountain fasting in deep meditation. Small colored pieces of cloth containing pinches of tobacco are wrapped around trees and bushes as prayer gifts to the Creator. Larger flags of red, white, black, or yellow, the sacred colors, also are tied to trees to carry the prayers to all the directions. Bear Butte, the mountain proper, is currently a National Historic Landmark managed by the South Dakota Game Fish and Parks Department. Although a few parcels of adjacent land have been purchased by some Native American nations, the rest of the surrounding area is ranchland, or is being sold to developers. Two drag racing strips, biker bars, a convenience store, campgrounds, and housing developments are all located within a few miles of this sacred place. In an exciting new partnership between the Coast Salish (indigenous peoples of the Salish Sea ecoregion) and the USGS, members of western Washington Tribes and British Columbia First Nations will measure water quality in Puget Sound and the Strait of Georgia during the Tribal Journey, the annual summer canoe voyage. The project will provide a snapshot of current water quality conditions and data that can be compared with future measurements along successive journeys. Cedar canoes traveled from various parts of the Puget Sound and Oregon, to the Swinomish Indian Tribal Community to rest overnight before going onto Cowichan, BC- this year's destination for Tribal Canoe Journey. Cedar canoes came ashore after a hard paddle on Monday- they had been going against the severe rip tide and afternoon wind, all safely making it to their host’s shores along the Swinomish Channel. Lummi; Nooksack; Grande Ronde & Warm Springs, Oregon canoe families, as well as Suquamish, Samish & Tulalip were the canoes They were greeted by growing crowd of friends, family and curious onlookers, who proudly welcomed the small band of canoes. Most canoes are able to seat about 9 people, per canoe and each canoe family averaged two full cedar canoes per family. Their ground crews had come ahead of them and set up their campsites on the Swinomish Ball Field, where they would be staying overnight, before they paddled the next day to the Samish Nation. As the sun was setting behind the Rainbow Bridge between Swinomish and the town of La Conner, WA , canoe skippers asked their hosts permission for their families to come ashore, some used their Native language as they were asking. Swinomish Chairman Brian Cladoosby and some of the other Senators warmly greeted the tired and hungry crews and quickly gave them permission and invited them to eat, sleep and celebrate on the Swinomish land. A big Salmon feed was put on and soon afterwards there was Protocol at the Swinomish Smokehouse- this where families come together to share songs and dance together. There were many young people in attendance and participating- which is a natural goal for TCJ- it is all about the youth & Elders getting together with each other; language preservation, healing and so much more. One of the very proponents of an American Indian Day was Dr. Arthur C. Parker, a Seneca Indian, who was the director of the Museum of Arts and Science in Rochester, N.Y. He persuaded the Boy Scouts of America to set aside a day for the "First Americans" and for three years they adopted such a day. In 1915, the annual Congress of the American Indian Association meeting in Lawrence, Kans., formally approved a plan concerning American Indian Day. It directed its president, Rev. Sherman Coolidge, an Arapahoe, to call upon the country to observe such a day. Coolidge issued a proclamation on Sept. 28, 1915, which declared the second Saturday of each May as an American Indian Day and contained the first formal appeal for recognition of Indians as citizens. The year before this proclamation was issued, Red Fox James, a Blackfoot Indian, rode horseback from state to state seeking approval for a day to honor Indians. On December 14, 1915, he presented the endorsements of 24 state governments at the White House. There is no record, however, of such a national day being proclaimed. The first American Indian Day in a state was declared on the second Saturday in May 1916 by the governor of New York. Several states celebrate the fourth Friday in September. In Illinois, for example, legislators enacted such a day in 1919. Presently, several states have designated Columbus Day as Native American Day, but it continues to be a day we observe without any recognition as a national legal holiday. In 1990 President George H. W. Bush approved a joint resolution designating November 1990 "National American Indian Heritage Month." Similar proclamations, under variants on the name (including "Native American Heritage Month" and "National American Indian and Alaska Native Heritage Month") have been issued each year since 1994. Theme for this year's heritage month is "Celebrating Tribal Nations: America's Great Partners." Interview with Attny Eric A. Seitz for Political Prisoner Leonard Peltier re-Parole Hearing 7-28-09 Literally we will be catching one of Peltier's attny's-Eric Seitz as he is heading out the door to join attny Bruce Ellison , to legally represent Political prisoner Leonard Peltier in an upcoming Parole hearing that could set Peltier free after being incarcerated for over 33 years. Many people know about a shoot out that occurred between two FBI agents and members of the American Indian movement, during the AIM occupation in Pine Ridge, SD. The gunfire exchange took place at the Jumping Bull Ranch. By the time it was over both FBI Agents Coler and Williams were killed, as well AIM member and Native American Joseph Stuntz . Peltier was fled to Canada, but was later extradited, tried & sentenced with two consecutive life terms after a jury found him guilty of their deaths. Redbone, featuring original founding member Pat Vegas, is a Native American rock group that reached the Top 5 of the Billboard Hot 100 charts in 1974 with the song, "Come and Get Your Love." The Pop/Funk song was certified Gold by the R.I.A.A for selling over one million copies is still heard today on radio stations throughout the country. Formed in Los Angeles, California, by Patrick Vasquez (Pat Vegas) on bass and vocals and his brother, Lolly, the name Redbone itself is a reference to the band members' mixed blood ancestry. Their first commercial success came with the single "Maggie" from their second recording, Potlatch, in 1970, and two other hit singles followed - "The Witch Queen of New Orleans" (1971) and "Come and Get Your Love" (1974). In 1973 Redbone released the politically oriented "We were all wounded at Wounded Knee" recalling the massacre of Lakota Sioux Indians by the Seventh Cavalry in 1890. Documents are supposed to be automatically declassified after 25 years under Executive Order 12958. The FBI is arguing that this material should not be subject to automatic declassification because it could damage or cause serious damage to national security and the so-called war on transnational terrorism. The FBI also claims that the release of the withheld documents would reveal the identities of confidential sources. Mr. Peltier's lawyers have argued that these are nothing more than pretense to prevent the release of further evidence of the continuing violation of Mr. Peltier's constitutional rights and further drives home the fact that Mr. Peltier never received a fair trial. In 2003, the United States Court of Appeals for the Tenth Circuit declared that, "Much of the government's behavior at the Pine Ridge Reservation and in its prosecution of Mr. Peltier is to be condemned. The government withheld evidence. It intimidated witnesses. These facts are undisputed." Nevertheless, Judge Frank found that any evidence of prior FBI misconduct was "irrelevant." Michael Kuzma, attorney for Leonard Peltier in both cases brought under the Freedom of Information Act (FOIA) said that, "The Courts are unwilling to dispense justice when it comes to Leonard Peltier." Kuzma went on to state, "How can anyone claim that Leonard Peltier received a fair trial in 1977 when the government withheld and continues to withhold thousands and thousands of pages of FBI documents?" Barry A. Bachrach, who served as co-counsel with Kuzma, indicated that he was, "disappointed, but not surprised that the Courts elected to summarily uphold the decision by the FBI to keep the documents hidden on dubious national security grounds." Bachrach went on to ask, "How can FBI documents generated over three decades ago possibly pose a threat to the national security of the United States?" Judge Frank's decision will be appealed to the United States Court of Appeals for the Eighth Circuit. Peltier attorneys have 30 days to file a Notice of Appeal. Robert Mirabal Bio: Robert Mirabal is a Native American flute player and recording artist from Taos Pueblo, New Mexico. His flutes are world-renowned and have been displayed at the Smithsonian Institution's National Museum of the American Indian. An award-winning musician and leading proponent of world music, Mirabal performs worldwide, sharing flute songs, tribal rock, dance, and storytelling. Mirabal has twice been named Native American Music Awards' Artist of the Year, and received the Songwriter of the Year award three times. He was featured in Grammy Award-winning album, Sacred Ground-a Tribute to Mother Earth in 2006 for Best Native American Music Album. He has recently also won 2007 "Best Male Artist" of the Year from the NAMMY's. Raised traditionally by his mother and grandparents on Taos Pueblo, Mirabal spoke Tiwa at home and began making flutes at the age of 19. In school, he had learned how to play clarinet, saxophone, piano, and drums, but found his true musical voice in the traditional Native American flute. He met the renowned Native American flute player R. Carlos Nakai as a young man and was greatly inspired by him. In the late '80s he moved to New York City, playing in a multicultural band made up of a Senegalese guitarist, a Cape Verdean drummer and Haitian keyboardist. There, Mirabal immersed himself in the sound of hip-hop, funk and R&B, which would inform his later trademark music. He recorded an independent debut album in 1988, and went on to land contract with Warner Western and later, Silver Wave Records. His first projects were generally focused on traditional music consisting of Native American flute and percussion. One of his early albums, Land was composed for Japanese avant-garde modern dancers Eiko and Koma, who choreographed a dance inspired by their impressions of the land around Taos. Cedar and clay flutes, percussion, rattles, and traditional vocals were used throughout the album. The acclaimed performance toured Europe and the U.S. and in 1992, Mirabal won New York's Dance and Performance "Bessie Award" for the score. Mirabal also published a book of storytelling poetry and prose in 1994 entitled Skeletons of a Bridge and is currently writing a second book, Running Alone in Photographs. Aside from his artistic talents, Mirabal is a father, farmer and horseman living in Taos Pueblo and participating in the traditional ways and rituals of his people. In 1996, Mirabal collaborated with Grammy Award-winning Native American singer-songwriter Bill Miller on an album Native Suite-Chants: Dances and the Remembered Earth. The project was both experimental and traditional, featuring flute and percussion as well as Mohican pow-wow singing. Mirabal came to greater national prominence during his performance in the 1998 PBS musical dance production, Spirit :A Journey in Dance, Drum, and Song, for which he composed the soundtrack for traditional flute and percussion. Due to the popularity of the program, the network went on to produce a music/dance program centered entirely on Mirabal and his traditional/rock fusion music entitled Music from a Painted Cave. The program and its corresponding CD release were enthusiastically received by mainstream audiences and became a benchmark World Music album. He also collaborated with John Tesh for the acclaimed PBS One World TV special for the millennium in 2000, which showcased music from around the world. In 2006, Mirabal launched his own record label, Star Road Records, and has released two CDs in the first year; Pueblo Christmas, a dozen classic Christmas Carols arranged for Native flute and cello; and In the Blood, a wholly unique mix of Native Roots, rock and Americana recently awarded "Best International Album" at the Canadian Aboriginal Music Awards. Norton Feb. 19, 2008 In the seventh day of a cross-country walk to protect sacred American Indian sites, a group of walkers prayed near the Washoe Tribe's sacred Cave Rock in Lake Tahoe on Monday morning. The prayer was interrupted by fishermen who wanted to use the dock, said Jimbo Simmons. "They came down saying how they paid for this dock and how long were we going to be there, and who do we think that we are to stand there and pray," Simmons recalled. "That was just a lack of respect. What we would like is respect." About 80 American Indians and others sympathetic to the plight left Alcatraz Island in San Francisco on Feb. 11 to embark on a 3,600-mile journey on foot to Washington, D.C. Expected to take five months, the Longest Walk 2 is to commemorate a march that was completed 30 years ago and to bring awareness to the environment and support the preservation of American Indian sacred sites. Simmons took part in that first walk when he was 22. Today, he is a coordinator for the event. This group walking the northern route arrived in Northern Nevada on Sunday night and walked from south Carson City to the Carson Colony on Monday morning. After taking part in a powwow and spending the night at the gymnasium there, they leave this morning to continue their trek to Silver Springs. On Wednesday, they move on to Fallon, eventually reaching Utah between March 1 and 3. The walkers expect to hit Colorado on March 14 and Kansas on April 8. And before their final destination in the nation's capital on July 11, they'll visit Missouri, Illinois, Indiana, Ohio, West Virginia, Pennsylvania and Maryland. The southern route walkers also left Alcatraz on Feb. 11 and will make their way through Arizona, New Mexico, Oklahoma, Louisiana, Mississippi, Alabama, Tennessee and Virginia. Willie Lonewolf of Oakland intends to walk the whole route. "I'm dedicating this walk to my ancestors," said the drum keeper and singer. "We need to be aware of what's going on in America." Tony Bautista of Sacramento is not walking any farther than Carson City. Life gets in the way sometimes, Bautista said, and he only had enough time to make the California-to-Nevada trek. But he felt so strongly about the message that the walk conveys, he needed to take part. "A lot of the Native American sites are getting exploited, and that's what a big part of this walk is about, but it's also about sacred sites from around the world," he said, noting one of the walkers is a Japanese Buddhist monk who came to the United States specifically for the event. Bautista said anyone can take part, even if they just walk a short distance. If you care enough about the mission, walking just a few blocks is enough, he said. "Yesterday when we were in Tahoe, there might have been 50 people walking. Today, the children from around here walked with us; there were at least 20 children around us," he said. GOOD AFTERNOON ROBIN, HOPE THIS FINDS U WELL AND GOOD.  WE ARE HAVING A WET WEEKEND, WAS HOPING IT WOULD STOP FOR A LITTLE WHILE, BUT GUESS NOT.  MY SIX YEAR OLD GRANDSON IS HERE, SO WE ARE WATCHING CONAN THE DESTROYER, HE HAS HIS SWORDS OUT AND IS HELPING HIM FIGHT ALL OVER MY LIVING ROOM SO IT WILL BE AN INTERESTING LONG WEEKEND.  ALL IS GOOD, HE WANTS POPCORN BALLS, SO I GUESS I BETTER GET BUSY.  WHAT REZ DO YOU LIVE ON IN WASHINGTON IF U WON'T MIND ME ASKING, I HAVE CLOSE FRIENDS AND FAMILY AT LUMMI.  HAVE A GOOD WEEKEND AS WELL, BLESSINGS ON THE WIND MY FRIEND

Hello friend, hope this finds u well. sorry it has taken so long to get in touch with everyone, it seems like this tour was really long.  it went well but it was long.  I so enjoyed my native brothers and sisters but I was not aware there were so many living there in Hawii, I felt kind of stupid when I found out there were so many.  It was a good surprise, and a rewarding one, they gave me great support and welcome on my books, especially the native stories, I hope I do as well here on my own home land as I did there.  But it was good to come home and feel the Earth under my feet on my own home land.  How are u and what have u been up to, good and good on both questions I hope.  Well I better stop loooking at my laundry and start doing it, it won't get done by itself, I need to get my catch up done and get my brain to working on a new book.  You have a great new week coming and I hope to hear from u when u can
