Kyle: Will the band/artist own all rights to their recorded material? Brendrum: For the most part, ownership of any recorded material is divided up into points, usually 100 per album. Half of these points are for the song writer and the other half are for publishing. Since I am doing the production, mixing, engineering, etc, I will take a portion of the publishing rights, 10 points of the 100.
Kyle: Will the band/artist be allowed to keep their master tapes? Brendrum: Yes, although I will also be part owner of the final tapes so if the band were to get signed by a major label they would have to buy me out, but those kind of details can be figured out when something like that happens.
Kyle: What is the time limit on the offer? (maybe the band can't record till later in the spring etc..) Brendrum: September
Kyle: How quickly/long can the contract elapse? (does the band need to do it in one quick shot, or can they spread it over short sessions over a period of weeks) Brendrum: If I state within the contract that the offer will expire in September then it doesn't matter when the material is recorded, as long as the combined recording time doesn't go over the limit. For a five piece band it isn't unreasonable to take up to 30 hours to record eight songs so I'll write the contract up to include 30 hours of recording time and 50 hours of mixing and mastering time.
Kyle: If the band has some recorded material already (like an EP etc..) can they add it to the final album? Brendrum: It will take some additional mixing to make it work, due to the fact the other material was recorded in a different room, using different gear, different plug-ins, with a different vibe (vibe has a lot to do with the sound of an album) etc.. but if I can pull it off without it making the album sound terrible I can definitely do that.
