Q: What happens when a probation officer makes a mistake ?
A: His client is punished MORE.
Q: What if the P.O. knows he is wrong and made a mistake ?
A: He doesn't care, he still gets paid.
I was just convicted of menacing my probation officer. In Ohio, that means that: I knowingly caused the victim to fear for his safety. Ohio Revised Code 2903.22 .
1 I didn't knowingly do such a thing.
2 He didn't fear for his safety. .
The deputy in his office filed the charges. Two counts of Menacing. .
I cannot prove that I didn't know what I was doing. Although the legal system in this country is set up so that the prosecution has the responsibility of proving that I knew. They didn't. .
I can however prove that he didn't fear for his safety. .
I have already spent almost two months in jail because of this. I soon have a probation violation hearing to determine my fate. Because of the conviction, which is a fourth degree misdemeanor, I'm facing two more YEARS in jail. My probation officer knows I'm innocent. As an officer of the court, he is violating his ethics by having any of these things happen to me. .
I represented myself in the trial. I know, I know, fool for a client, ha ha. I feel that attorneys are needed for guilty people. I feel that deals from the prosecution are for guilty people. I have three pending traffic citations. Two different prosecutors offered to drop four of the charges & amend the remaining Menacing charge to Disorderly Conduct. What a fantastic deal for a guilty person. I'm not guilty of any of them. I turned down their offer.
