SUBJECT: NAC goes back to court over San Onofre
TO: Naturists and other concerned citizens

Dear Naturist or Concerned Citizen for Individual Freedoms in Our Country,

As a result of the Naturist Action Committee's recent victory in court, the traditional clothing-optional portion of San Onofre State Beach remains open for nude use, the Cahill/Harrison Regulation has been recognized as a state regulation, and no citations for mere nudity are being issued at the beach. NAC's win is significant and meaningful. However, no one should imagine that it's the last word in this matter.

As NAC has anticipated, the California Department of Parks and Recreation (DPR) has filed its intent to appeal the recent Superior Court ruling. NAC has already prepared for the state's appeal and will meet that challenge in the Appellate Court. The California Attorney General's office is representing the DPR. To succeed, the AG will have to convince the Appellate Court that Superior Court Judge Sheila Fell "abused her discretion." That's a very difficult case to make.

In her ruling just a week ago, the Judge Fell said, "until the administrative process is completed, Parks shall maintain the status quo, and enforce the Cahill Policy as it has done since its issuance and subsequent interpretation by the Harrison letter, at Trail 6 in San Onofre State Beach." However, the DPR has very pointedly refused to remove the "no nudity" signs that were installed when the Department attempted to rescind the Cahill/Harrison Regulation for San Onofre State Beach. NAC will be in court this week to ask the judge to insist that the signs be removed as a part of the return to the "status quo" that has been ordered.

COURT ISSUES FINAL RULING IN FAVOR OF NATURISTS IN SUIT AGAINT DEPARTMENT OF PARKS AND RECREATION

Late in the afternoon on August 27, Judge Shelia Fell issued her FINAL ruling on our Petition for Writ of Mandamus. The final ruling mirrored the tentative ruling of August 19. This ruling affirms the fact that nudity is legal at Trail 6 (and all other traditional clothing optional areas within the State Parks) unless a complaint is received from a member of the public. Also, the ruling affirms that the Department must conduct public hearings in accordance with the Administrative Procedures Act prior to making any changes in its enforcement policy regarding nudity within the State Parks.

Where do we go from here? The DPR essentially has three choices. First, it may choose to move forward with the proposed change in policy and proceed in accordance with the Administrative Procedures Act. Second, they may appeal the Court's ruling that came out today. Or, third, they may choose to simply stick with the existing policy. It is our hope that if they choose to retain the status quo, we will be able to work with the DPR in order to improve the park for the benefit of all the visitors and employees of the DPR alike. In any case, the Naturist Action Committee and Friends of San Onofre Beach are ready to proceed in which ever manner is appropriate depending on what path DPR chooses to take.

We deeply appreciate the support of all of you who participated in making this ruling possible, whether by writing letters, making donations or simply kind words of encouragement on the beach. Keep up the good work!

This should be a reminder to everyone of the importance of being affiliated with a national organization that supports clothing optional beaches and understands exactly how to protect and advance the rights of naturists. I strongly encourage each of you to join The Naturist Society. It is TNS and its political adjunct, the Naturist Action Committee that have brought their expertise and national clout to the table to make this effort a success. The beach was saved! Thanks to Allen Baylis, NAC and everyone that spoke up!

San Onofre Beach at Trail 6 has been a clothing-optional haven for nature lovers for over 30 years. Now the the California State Park System is planning on taking away this small stretch of clothing-optional paradise unless we all speak-up!

On May 19th 2008, Ruth Coleman, Director of California Department of Parks and Recreation had issued an order revoking the longstanding "Cahill Policy" as it applies to the San Onofre trail 6 area, effective Sept. 2, 2008. The day after labor day.

Allen Baylis, an attorney, said the naturists have a right to be nude at Trail 6 because of the Cahill Policy, written in 1979. The rule states that "enforcement of nude sunbathing regulations within the state park system shall be made only upon the complaint of a private citizen. Citations or arrests shall be made only after attempts are made to elicit voluntary compliance with the regulations."

It needs no excuse, nor do the many millions who share its delights need
to be told how beneficial it is to them. They know that they are healthier
and happier men and women, and therefore get more out of life and
give more to others, because they dance. If the purpose of life is,
in the words of an immortal document, the pursuit of happiness,
surely those who train their bodies to move in harmony with
natural laws are fitting themselves for capacity to enjoy
all that life brings. To live well requires good physical health,
for which a prime requisite is an abundance of
pleasant exercise. Not alone to those who are free from the
necessity of the various forms of exertion that are termed
"work," but to every human being, exercise is as
necessary as food. To those whose daily callings involve
substantial physical labor, the need for exercise is just as great as
for those of lighter employments. And nowhere can there be
found so satisfactory a bodily exercise as in the dance.
Sports, outdoor games, horseback riding, etc., have their place, but are
available to a comparatively small percentage of all the people.
Now that the introduction of the automobile has turned
America into a nation of riders on soft cushions, the need
for proper exercise has become more important than ever.

So about that straw and bamboo hut Mo and I built...we returned to the beach on Saturday to find that someone burned it down. They even tossed in our clothes line and burned that to. Next time, we are building a bigger and stronger hut made of stone. I can now relate to three little pigs felt when the big bad wolf huffed and puffed and...

The beach was amazing this weekend! I finished my bamboo and straw hut along the beach, learned how to surf and met some really chill peeps. There was even a thunder storm just over the ocean. Absolutely amazing!! Oh, and I was naked. ;)

* If you go down there this week, please keep an eye on our fort. Two ranger trucks went down to the beach just after we came up the trail...I am hoping they did not destroy it.

Story for ya...The Park Ranger gave Mo and I a lil visit Sunday Evening. He seemed quite nice and was very informative about the State park regulations...catch 22...we were parked on the Federal side.
