A year after the Supreme Court's Kelo decision, Reason's Adrian Moore is not impressed by the eminent domain legislation that has been passed to "protect" homeowners. Moore writes, "It turns out that city and county governments and redevelopment authorities were pretty effective lobbyists, and often managed to retain a lot of authority to use eminent domain and define limits in very subjective terms. In a world where legislators, and most of us, have gone squishy on what a right is, where 'stakeholder buy in' is the ultimate cachet, passing laws that just plain say, 'look, you can't take someone's land except on rare occasion for public infrastructure projects like roads, dams, etc.' is just too extreme. It is a conflict of visions. As one city manager told me, 'What about the community's right to improve itself and create new jobs?' There is a reason the Constitution doesn't mention 'community rights' — they don't exist. Only individuals have rights. Communities have desires."
