I am a current Beazer homeowner in the midst of the battle of a lifetime all because I worked my butt off to buy my first home; which was not easy being a single mom. The reason for this myspace is I will do everything in my power to stop Beazer Homes from building one more "lemon" home & causing one more family to be as devastated as mine.
First, PLEASE check out the links because I am NOT making up anything here - see the facts for yourself. They have repeatedly been sued & LOST millions in settlements SINCE 1993 & the eerie part - read the articles - the complaints are the same - a lemon home with electrical, HVAC, plumbing problems, very poor construction workmanship, very poor quality materials, yard sloping issues resulting in flooding & moisture problems which leads to mold. The corruption starts at the top with Ian McCarthy, President & CEO who's currently under an SEC investigation for possible fraud with his stocks. There is a previous SEC violation from 2002 when Beazer bought Crossman communities - insider trading that time. They have 2 SOX Compliance violations - see Fuller v Beazer. They are currently under investigation by the FBI & HUD for mortgage fraud, there are 2 class action lawsuits from the shareholders for fraud over the stock, & then yet another lawsuit involving fraud with the employees 401k program!
Can someone please tell me WHY me & my kids lived in our brand new home for less than 2 months & were sick the entire time which resulted in us being so ill we moved out & left all our belongings behind because my mold test results showed that my house had 7 types of TOXIC mold along with a lot of other non-toxic types when they have been repremanded repeatedly all across this country for the same thing??? And guess what - when Beazer hired their own company to test my house for mold - they found more kinds of mold than the company I hired & they found 2 MORE TOXIC MOLDS THAT ARE USED IN BIOLOGICAL WARFARE!!!
And I was dealing with all of us being sick on top of uneven walls (there's a BIG problem when a 9" paint roller does not touch the wall across all 9" - that's how uneven), floors & ceilings, the glue on my hardwood floors continually seeping up, my windows being steamy, my AC not working properly, several light fixtures or outlets not working, no grout in places in the tile, no shower rods in the bathrooms - the parts were laying in the tub BUT not ALL the parts were there, the tile & grout in one bathroom was cracked, the grout in front of the front door & door to the garage was cracked & breaking up, the little cement step just outside the back door was crumbling, the tree in the front yard died well before close & they said it was going to be replaced & it wasn't, & on & on goes the list.
Then, within the first 10 days of moving into my brand new house, every neighbor that came to meet us & welcome us told me horror stories about dealing with Beazer for warranty repairs, about how the whole neighborhood had all the same problems & I was given check lists from them & some of them even came in & checked the things themselves, I found out the Home Owners Association was being run illegally & that there was a group of neighbors trying to start a class action lawsuit. Nice welcome to the neighborhood! There are 2 homes that Beazer bought back & the people were shut up very quickly because of major mold. There are 2 others living there currently with mold - one has extremely sick kids & the other has visible mold in her kitchen because everytime it rains her back yard floods which then the water runs in her back door into the kitchen - Beazer cleaned her kitchen with bleach & said they remediated the mold - YEAH Right!
First, the Sales Contract they have you sign on a brand new construction home has several fraudulent items in it. Second, it also has a forced arbitration clause which names CAS (Construction Arbitration Services) as the arbitrator - well all I'm going to say it check out the links - CORRUPT as corrupt can be.
REPORTED MOLD SYMPTOMS

Here are more unhappy Beazer homeowner's stories of their battles:
In the winter of 2005, we noticed that our wood floor in the kitchen was starting to buckle. We live in a 6-year-old home located in Santa Clarita, CA built by Beazer. A call went out to Beazer and a Customer service representative paid us a visit. The sliding glass door was checked for leaks by an independent door co. As was all the plumbing by a leak detection co. No leaks found anywhere. Beazer’s answer was to replace our floor. Not thinking it a good idea to replace the floor without finding the cause, we did go to the design show room for Beazer and had one of their associates pick a floor that was comparable. We did not do anything until the winter of 2006. We wanted to know where the water was coming from. January 1, 2006 it was pouring rain and water was coming up between boards in our kitchen 10’ from the door. Another call to Beazer, another visit from the customer service rep and door company. Again, the slider still was found to have no leaks. The Beazer rep decided the leak must be coming from the slider and decided the door must be changed. March 13, 2006 the new door was being installed and the installers found mold under the floor at the threshold and moisture on top of the header. The floor was so wet under the threshold and wall; they needed fans to dry the area to install new doors. (The mold found under the floor and in the wall next to the slider was later proved to be stachybotrys or the “toxic” mold by a mold investigator we hired ourselves.)Beazer reps came out on the next day with a mold remediation company, we were told it was not that bad and half our kitchen was quarantined and half our master bedroom, which is above the kitchen slider. Our master bedrooms window was found to be faulty and the cause of the water on top of the header downstairs. March 14 2006 we were told we had to get out of the house because the intrusion of water was more severe than thought. The water was all through the lower level. The entire wood floor downstairs plus most of our lower kitchen cabinets removed. In doing this, our entire downstairs was packed into boxes by people from the mold remediation company. Our refrigerator and stove was moved to the garage. In their attempt to move our year and a half old refrigerator, they dented it in noticeable areas. Breaking our counter top tiles in the process. Beazer told the mold co. to try to save the counter tops and they put sticks under the cracked broken counter tops in hopes that they could build cabinets underneath them and just glue the broken tiles back together. A week and a half later, we were clear to move back into the house after air sampling is done on March 24, 2006. There were plastic contained rooms all through out our house, stapled and taped to our ceiling. All of our downstairs belongings were packed and shoved haphazardly into two rooms that have carpet. Nobody from Beazer or the mold co. removed any of the plastic walls put up to contain the mold. Nobody moved the refrigerator or stove back, nobody unpacked any of the boxes. We were left with outlet covers left open, counter tops on sticks with broken sharp edges, open walls with no dry wall, concrete floors with huge cracks and two rooms from floor to ceiling that was packed with boxes and all our downstairs furniture. There were no baseboards and most of the door jams missing or damaged. Carpet tack strips in daughter’s bedroom missing, and the master bedroom the carpet pad and tack strip was missing. The carpet was left filthy and had paint drippings. It was like being hit by a flood or tornado, where do we start? We shake our heads and get back to business. How do you build cabinets under broken tile tops? Will the new cabinets match the old cabinets that are left? How will they dry wall under cabinets 24 inches deep? When will the drywall be replaced? How will they fix the broken tiles, is the grout going to look funny? How much more damage is there to our belongings? We cannot even get in those two rooms to look. Is there more mold in those two rooms? Did they check them? We decide to speak to the Beazer reps about our questions. We are told first, there is no mold in those rooms with carpet, and that carpet breaths. We are told they are able to glue the broken tile back in place and indeed, it will not match the grout. The cabinets most likely will not match due to the rest being 6 years old, but they are able to do that and we should read our owner manual of our house “it’s in the contract.” We were told that it was Aeroscopics problem about the damage to our refrigerator. We were told the drywall would be the first priority and work would start soon. We were astonished by their seemingly lack of compassion and weigh what we should do. We decided to ask if there would be anyway to do it ourselves and receive money instead of them putting our kitchen back in what seemed to be a band-aid remedy. Beazer seemed happy about that and offered $3400 for our cabinets, $1500 for our tile tops and $13600 for our floors. We were told we would have to sign a release of liability for those items. At that price, we did not think we could do the kitchen ourselves and we would start to go price what a new kitchen would cost. Meanwhile the floor amount was fine because we were using the amount they would be paying through there own design center. We decided to let them replace the drywall. It was hard to be optimistic but we tried. We thought about moving a couple pieces of cabinetry to other parts of the house due to a new floor being put in. March 27, 2006 we found more mold behind a Beazer installed cabinet at the end of our hall. We immediately called the Beazer rep to let him know our new finding. March 29, 2006 Beazer rep came, saw, and called the mold company to come
take care of this new mold. March 30, 2006 Aeroscopic, the mold co, came to remediate the mold, but could not determine the source of the moisture. There were visible water stains on top of the mud seals. Aeroscopic quarantined the area until air sampling could be done. Another question to Beazer, are we going to continue to find mold ourselves? Beazer and Aeroscopic have cleared the house but we keep finding more mold. Is this a health hazard to our family? We have three children. The oldest daughter has severe asthma and even has been intubated on one occasion and hospitalized more times then we can count due to her condition. The youngest being three is still growing; what has it done to her lungs? March 30, 2006 due to our childproof cabinets being taken out and destroyed, we no longer had a good place to put our medicine. We chose the bathroom medicine cabinet. Unfortunately, our daughter is a very good climber and decided to taken over two doses of adult Nyquil. Heck, I can’t even get the lid off so I do not know how she did! An immediate call to the poison control said that it might be a lethal dose. We called the paramedics, when they arrived, they determined that the situation was critical, and she and I were transported by helicopter to children’s hospital in LA. We spent the day praying she would
survive. As a result of the accidental poisoning, we were required to be interviewed by social services to determine if it was a case of unfit parenting, neglect, or lapse in child safety. The social worker assigned to our case after hearing our story felt sorry for us and concluded that this was not a case of bad parenting but a case of very bad circumstances that had finally caught up with us. Thank God, our daughter responded to the treatment and after having to consume charcoal, has fully recovered. April 10, 2006 Beazer finally begins work on our home. Drywall people cut drywall and the boards go up. They inform us, as well as a Beazer rep, that they are unable to reach under the cabinets that Beazer has tried to save, and they too will have to come down. April 11, 2006 I am informed that I must pack the rest of my cabinets due to the fact that workers were coming on April 12 to take them down. It was my 39th birthday, and I worked from sun up to sun down packing the rest of my kitchen crying the entire day. April 12 2006 Beazer’s workers came and removed the cabinets. They were over double what they had originally taken out. Left a mess for me to clean and left. I told the Beazer rep that was there that day I had questions about their offer and nobody responded. A Beazer rep called with another offer for price of cabinets and tile. They doubled the original offer but took out over twice as many cabinets. April 13, 2006 we were told food allowance was stopped because we did not make a decision on their offer. We still did not have a kitchen. We asked Beazer questions about the kitchen on March 20, 2006 and did not get an answer until April 11, 2006, and were threatened by Beazer to make a decision right then. Talk about strong-arming. We countered that offer that they should at least give us two more weeks food allowance #1 due to the fact that they drug their feet even getting back to work on our home, #2 it would be a minimum of two weeks to get cabinets in from them. I was being generous with the timetable. #3 it was going to be a minimum of 5 weeks to get cabinets for us if we would have ordered them that day. We thought that only fair. Please note we were offered a motel stay during the destruction of our home and declined because we have a travel trailer and pets with special needs. We saved Beazer thousands of dollars by living in it on our driveway. April 24, 2006 a phone call was made to a Beazer rep discussing the food allowance. While my husband was on the phone our three-year-old noticed an outlet cover missing at her level due to the drywaller. The outlet cover and a screwdriver were behind a plastic wall we still had up in our home. Our three-year-old daughter found it and was “trying to fix our house.” She could have been killed! There was a flash. I screamed scaring her, thankfully, and she dropped the screwdriver. I do feel the need to tell you all about the drywall that was repaired in our home. The repairs started on April 10, 2006. The areas that needed drywall were next to the sliding glass door approximately 3’ by 8’, all throughout the kitchen about 2 feet from the ground, an area at the end of the hallway approximately 3’ by 5’, the master bedroom approximately 10’ by 3’ and two smaller areas next to the front door and the office downstairs. Beazer workers could not get the walls either straight or done with a satisfactory texture to match the old. The workers even tried to mud the wall about an inch thick to straighten it. I asked the drywall company T&R owner, my self “Isn’t it going to crack due to it being too thick?” His answer was condescendingly NO! Well it did crack and fall from the wall. T&R kept trying to fix it with more and more mud. T & R kept trying to fix the drywall areas mentioned for almost four weeks. It was ridiculous. At one point I was so sick of their work I finished the master bedroom myself. I had to retexture what they thought to be done, primed, and painted it myself. I stepped back to look at my work and stepped on a nail plate. OUCH! The nail plate was hidden in the plastic. To my horror, I found three more. This meant that there were no nail plates in the wall to protect someone if they were to nail or drill into an electrical wire. It is a building code. This also meant that the drywall that I had finished would have to come back down and be redone. I placed a call to a Beazer rep and his answer was “you only need them if you don’t know where the wire is.” My reply was “it’s code, and how do I know if I sell my house that the next owners wouldn’t hurt themselves?” The drywall came down and another Beazer rep came with nail plates and put them up the next week. The downstairs drywall was taken down finally due to another Beazer rep agreeing that is was a bad patch job. Fortunately, my husband was home when they started to replace the piece they could not get right. Beazer had a framer here for another problem I have not got to yet, and he (the framer) could not figure out how to frame it straight without my husbands help. After that, T&R kept telling us
they would be here and not show up or call. A Beazer rep was here at the house the day they said they were coming and placed a call to them, and let them know they were no longer welcome to work in our house due to having enough of their terrible work and lies. A Beazer rep brought out two more workers the week of May 2, 2006 and the drywall was completed according to Beazer on May 8, 2006. Nicks and gouges from workers have been left for I guess us to finish. We had a broken toilet lid in our master bath that just so happened during all of this other stuff going on in our home. My husband and I purchased a new toilet instead of trying to find the lid. On April 22, 2006, we went to install the new toilet. We found that there was a leak under the toilet for an unknown amount of time. There was mold all round the toilet on the sub floor and up the back wall of the bathroom. We reported it to Beazer and two reps came out and determined that indeed the toilet had leaked possibly due to a failed wax ring. Beazer told us that homeowners should check the wax rings periodically to see if there are leaks as part of our home maintenance. A letter was delivered to us by a rep and it stated that the sub floor around toilet would be replaced, the affected drywall and baseboards removed and replaced, and vinyl flooring we had was discontinued.
We were told to pick a comparable product and it to would be replaced. April 28, 2006 the sub floor was repaired. May 8, 2006 vinyl floor was installed using our fans due to overbooking and the installer running out of time. We felt bad for him and gave him coffee and cleaned up after him so he could get home, it was after 8pm. We tried to install the new toilet but it rocked. The sub floor had been done wrong or the floor guy didn’t put enough patch there to make it level. A call went to Beazer and two reps came out and determined that the vinyl should be redone. Problem was they could not get him back for another few weeks. I was having surgery and I asked my husband to rig it somehow so I would be able to use it after the hospital stay. This way we could at least use it until it was repaired. My husband used shims and left it at that until the floor guy showed up unannounced 4 days after my surgery. The floor guy said that it was normal to shim a toilet and that it should be fine, I couldn’t get a hold of my husband to let him know that the guy just wanted to caulk the shims and go, so I let him talk me into his fix. My husband is not happy about this, so he called Beazer to voice his concern. He took out a toilet that didn’t rock, why should we have to live with one now due to another builder defect in our house. We have yet to hear back from Beazer regarding this matter. I cleaned up after the floor guy like I said, and I didn’t know he was told by the Beazer rep to save the base moldings. I had gotten rid of most of them. The Beazer rep was not too happy about it and went to get molding, He used our chop saw to put up most of it and must have been late for another appointment and told ME how to finish the rest. Needless to say, it’s still not finished. Getting back to our nightmare, we agreed verbally to Beazer’s offer for cabinets and tile and floor. We knew it was too little but we just wanted our house back, and thought we would do a little upgrading to be optimistic about a very bad situation. We knew we would have to sign a release of liability for the cabinet’s, tile tops and floors if we were to accept money for these items. The release came on April 26, 2006 without a check. We had told the Beazer rep we would have someone who understood legal terms look it over before we would sign anything. The release went as follows; #1 The settlement agreement and release is made the 18 of April 2006.(we didn’t receive this agreement for 9 days after they wrote it) #2 A, the purchase of our house in Corona Ca. experienced water intrusion and associated water damage has been repaired. (We do not live in Corona nor has all the water intrusion been repaired)B The parties by this agreement to settle, finally and completely, all claims, demands, actions, causes of action and rights know and unknown arising from or related to the water intrusion and water damage at the subject property. (We have no idea of the damage to personal belongings packed by mold abatement co. and the refrigerator is ultimately Beazer’s responsibility) #3 Beazer agrees to pay $28,600.00 in full settlement of this matter. The breakdown as follows: Flooring $13,600.00, Tile $3,000.00, Cabinets $6,800.00, Food $5,200.00. #4 Releases A buyer hereby fully and finally settles releases, acquits, forever discharges, and covenants not to sue Beazer with respect to any and all claims or causes of action of any nature and kind arising out of or related to the water intrusion and water damage at the Subject Property. (Are we to take it that when we do unpack and find damage and more mold we are supposed to take care of it ourselves) This Agreement may be pled as fully and complete defense to any such action or other proceeding, as well as the basis for abatement of, or injunction against, such an action or proceeding. B Waiver of civil code 1542 (So if anything else happens to the house
C.due to another builder defect we can NEVER hold Beazer accountable) The Parties acknowledge and understand that there is a risk that now or subsequent to the execution of this agreement they may have claims arising out of or related to the 21 enumerated warranty items set forth in Exhibit “A” which are now unknown and unanticipated at the time this AGREEMENT is signed, and that any claims as are now known or should be known to buyer may become more serious than they now expect or anticipate. Likewise, defense is presently unknown may come to light. Nevertheless, the PARTIES hereby expressly waive all rights they may have in such unknown and unexpected consequences or results. The Parties understand California Civil Code 1542 and expressly waive its provisions, which provide: (We do not know there are 21 items, never heard that their were that many problems with our home)The contract goes on to 8 items, with #8 having A through J. Guess you can tell what we had to do next. Find a lawyer quick!!!!!! The whole time we had been going through his nightmare we were told by Beazer reps if we were to seek legal help all work would stop. We were also asked repeatedly not talk to the neighbors. It was apparent to us at that point that Beazer was covering their butt. They have a whole TEAM of lawyers that have had privy to our terrible situation, and it left us in a scramble to get help. We are humble people who just wanted our home back at that point. We contacted a couple lawyers who seemed to see dollar signs and wanted to send out flyers for a class action lawsuit. We did not want to go that route; again being optimistic about the situation, we thought it was just bad luck that we happened to have the “lemon” house in our development. We had been very patient with Beazer and even decided to do some repairs on our own rather then fight them. I was going to do the custom painting that had been destroyed. We replaced the front door and side light that had a leak. Beazer told us that they would come in while the floor was concrete and put back the base moldings that had been removed. We asked for an allowance and the answer was no. Wood floor should be put down before the moldings, but they felt the opposite. There were several nicks and gouges left in the walls that we decided just to repair ourselves. We paid for our own packing boxes for the rest of the house that we had to pack. We were left to fight with the Mold Co. to replace our refrigerator. Aeroscopic wanted to give us a depreciated amount of $1200 and take the one they damaged, sell it to recoup their losses. This debate is still going on. I guess we need to call the contractors board. We finally find a lawyer who sees our side that we just want our house back. She is now working with us and we were hoping it would not come down to a fight. We unpacked the boxes that the mold company had packed and piled into two rooms that had the carpet. Upon opening the boxes, most everything was unharmed. Unfortunately, a custom king chair of leather and chenille had been stacked on each other, and one of the arms of the chair is dented and has not come back to normal shape. We paid $3700 for it just a year ago. We were also curious to see if the two rooms were checked for moisture. We were told they were checked and that they did not have a moisture problem. June 6, 2006 we cleaned out the two rooms that had carpet. We found a significant amount of moisture in the carpet pad as well as the carpet. The carpet was uniformly stained by moisture. We took off the baseboards and found more mold. The tack strips were totally moldy and damp. We placed a call to Beazer and a rep came to see our newest findings. He said yes, there looks to be a problem, I will have someone get back to you. That was the last time we have heard from Beazer until August 14, 2006. Because of Beazer’s lack of response, we opted to call our own companies to determine if our home was safe. We hired a Dr. Severs from EHC1. Dr.Severs found mold on a base plate that had been previously encapsulated for mold by Aeroscopic. Water is coming up through our concrete, which is attached to mud seals, which is attached to drywall and studs. Drywall grows mold. Drywall acts like a wick for water and if continually supplied with water will grow mold. Beazer’s seemingly lack of concern also prompted us to hire a building specialist. We hired JPS Design Group. Jeff the head of the group came out to our house to see the damage and make a report. Jeff’s Company specializes in architectural forensics, designs & construction. For us, unfortunately, he is not a water investigator. Jeff did however come up with the sum of $106,174.37 to fix our house. Jeff was very thorough; he included carpet cleaning, missing pads, tack strips, and re-stretching. He also included paint costs and outside damage to landscape due to paint or stucco being cleaned out in flowerbeds. We also took Beazer’s advice and checked the other toilets for leaks. Good news, no leaks but unfortunately the kids bathroom has linoleum and was cut around the toilet and after checking the wax ring and putting the toilet back it will not line up properly. This is now a health hazard due to the sub floor showing. I’m not sure if this is even to building code. Jeff included this cost as well. This amount is without lawyer fees, his fees, and loss of income and the moisture intrusion problem. Nobody so far has come up with a good remedy. We sent all of these reports to our lawyer, which was forwarded to Beazer. Beazer sent out the head of Aeroscopic to do slab testing. Ian the owner of Aeroscopic came to our house at the end of June, 2006, did 9 calcium chloride tests and said he would get them back to Beazer. The testing took 5 days. We asked Ian how he thought our problem should be solved. He said,” Seal the floor.” We asked what about the mud seals. He said” they breathe and will be fine.” We are left thinking, what about the mud seals that have been encapsulated they do not breathe. What about the drywall attached to the mud seals it breeds mold. Dr. Severs confirms our fears. We would ask the lawyer periodically should we have heard anything from Beazer? She would reply yes and call Beazer’s attorney. The answer was the same for about a month now, we would be hearing from someone. The leak detection people we had two years prior to this mess again came out to find no leaks. We have heard from a Tom Cook that Beazer hired to look at our train wreck for a home. We had hoped he would be the one to tell us where the water was coming from. He was not. He was like Jeff from Jps, a cost analysis person. I cried because they just kept sending the wrong people. Beginning of August, we heard from a concrete Co. that wanted to come out and I got excited. When he came he said he was not the guy to fix the water he was merely the guy to seal the floor. I cried. That does not take care of the water coming up through the concrete hitting the mud seal that’s attached to the drywall. A call went to the lawyer; she said we would get a call from a Beazer rep to have our family relocated. I cried again! In the middle of this mess I mentioned to you that I had surgery, I have TMJD. I was in a car accident at 17, I was thrown through the side window, and the car landed on me. I sustained many injuries, which included breaking my jaw straight down the middle. My cheekbones shattered as well. This has caused a life time of pain to certain extent. I had open joint surgery on my left side in May in the midst of this mess with my house. The surgeon tried to save my disc. My left side mandibular fossa was reshaped and adhesions removed. (He ground down the bone in my jaw and scraped the scar tissue) It was quite an extensive surgery to withstand due to the stress I was under. As you know sometimes, we have no choice what life gives us. The Dr. tried to save the disc by stitching it in the place it is supposed to stay. Three weeks post op I tore the stitches in my jaw clean out in my sleep. I am under so much stress due to our house, I must have been holding it in my face and jaw, like we all do. I had to forgo surgery again ASAP. The Dr. waited until the swelling went down and I had surgery August 2. It went a lot longer then thought, there was a ton of scar tissue, and the disc could not be saved. I ripped it in two. Stress is a bad thing on our body. The Dr. took a stomach graph and placed it in my jaw where my disc used to be in hopes that will be a solution at least for a while. I do know it still hurts, and it is partly due to this stress we have to go through unfairly because of a builder defect. I now will probably have a lifetime of pain and surgery due to this stress we have had to endure by no fault of our own. Thanks Beazer. I did finally get a call from Beazer on August 13, 2006 It was a rep! He wanted to make an appointment to order floors and put in cabinets. When I called him back to tell him we have already ordered cabinets and floor (he must have known) and that we were waiting for a Rep from his Co. to relocate us and figure where the water is coming from and fix our house! If you put in cabinets and floor, they are once again going to get moldy! The furniture that is on the concrete is stating to get moldy! I told Aeroscopic when Ian was here about that problem, he said they would fix it. He has not fixed it! The Beazer rep seemed like he did not know any of these things and promised me he would get back to me that day and let me know what he found out about the lack of communication in his company. He did not get back to me. I placed a call that evening to him and left a voice mail stating “ I thought you were going to get back to us. I thought that you were sincere about trying to help us, and I was glad to hear from you because you have been working with us from the start. Well another day bites the dust; I guess we should be used to it. It has been 5 months now without a home!” I placed another call on August 18, 2006, again voicemail no response. So here, I sit to tell you my story. We hope this never happens to you. We have a better understanding what hurricane and tornado victims go through. But this is not a natural disaster it is a builder defect from a fortune 500 company who seems to care less about our home or family. We have spent all of our savings and now have gone to using credit unfairly to get our home back because the Beazer Company really does not seem to care about the average family. They care about making money and that seems to be about it. We would never buy another Beazer home, and I suggest you should do the same. We want to get the word out so this never happens to another innocent family. It now is a over a year and I pray everyday that SOME will help us, we have a new lawyer that seems more interested in his own payment then us. It’s been two weeks since we have heard from him. Please, I beg of you, this is our 5th time trying to get a hold of someone who cares about a humble American family who is having to live in condemnable situation due to a fortune 500 companies lack of concern. PLEASE HELP!
I have approximately a 1300 square foot "energy efficient" home built by beazer. I had to have my window ripped out and replaced because it was not square and had a 1/4 in gap in the bottom right and 1/4 inch gad in the top left of the window. I pointed it out before and during and after our closing meeting and was told it was a problem with the actual window and they would correct it. It took forever to get someone to finally come out then "big surprise" it wasn't the window, it was the shotty workman ship of Beazer and their contractors. The frame was not square, they came and ripped out all of my brick and my window and then were going to put it in exactly the same way because they couldn't fix the frame not being square but I had already had and was still having so many problems that I threatened a law suit and they went ahead and put the window in square but then just quickcreted the remaing gaps between the frame and the actual window. I had serious air conditioning issues and I continue to have them. Beazer will dally around my complaints at the beginning of summer and try this and that to correct it, which just takes up time and will then come up with the "perfect" solution right as it is becoming cooler and I don't realize that it still does not work correctly untill the next summer and guess what, they are not responsible after a certain amount of time, my upstairs was 102 degrees today with the air running upstairs and down. If I run my heat/air at way below/above the 68/72 that is recommended for energy efficiency (I usually will try to run them at 66(heat)/76(air) for just a few hours a day my electric bill runs way up over 250 - 300 dollars. I am afraid to run them to actually keep my house cool because the way it runs it will be 400 dollars+. My neighbors who have the same house plan as me (I know there are 3/4 of this plan (the arlington)) are all having the same issues with upstairs but they run their air and heat more normally than mine and their electric bill are up over 400 and one of them was just forclosed on. (I believe the plan is flawed and they discontinued it after the 4 were built becasue of the problems. There are documents within beazer and I still have copies of some of my emails including one from Peter Canalia, who was president of Memphis Beazer, stating it is embarassing the problems that they have with my house.
I pointed out things in my walk through and then was told by a very angry Jim Jackson that those items were not a reason not to close and I had better do it and after calling my closing coordinator, she told my that was correct and I needed to go ahead and close, I did. I am a single parent of 3 and this is my first home, I did not have anybody with my to handle this but me. My house was supposed to be handicap accessible and I ended up with a partially accessible guest bathroom after I had the realtor quote the ADA to them when they denied my request because it was a bother to customize their standard plans. They raised the price on my to do it but I had the original paperwork where it was requested, quoted and agreed upon. I did not get a ramp built until several complaints later and it doesn't match my other concrete which looks terrible. The neighborhood was promised walking trails with benches, a place for the kids to play and beautiful ponds with fountains, instead we have stinky, mosquito breeding, things that are unhealthy to say the least and our children only have the street to play in, and it is against the rules for them to play in the street so they play in the ditches and that is "REALLY SAFE". There are more than several unhappy homeowners some, like me, are lower income, several are single parents and/or young couples, and I think we think that having moldy homes with outrageous utility bills, flooded yards, crumbling sidewalks (see drain by my house), etc. is better than having no home at all. Don't get me wrong, my house looks good, and it is my home, but I can see the light through every part of my front door if I am outside looking in. I could open my garage door with a spoon, I have serious concerns about insulation in my walls I know I have no interior insulation ( apparently in TN that is not a requirement ). My house passed inspection on plumbing and electricity but my guest bathtub piping was not saudered or welded or whatever you want to call it so when I turned on the water, it ran inside the wall and had to be fixed and I found out a year later, when my daughter finally was old enough to use curling irons, etc and none of the bathroom outlets worked ( they would reset but when you plugged in something it would trip the circuit) that the wires in my bathroom were crossed! So how did this pass inspection? My hot water heater did not pass several times and I don't know what they did to make it pass but I have a jaccuzzi bathtub in the master bath and the hot water doesn't last long enough to even fill it halfway at a reasonable temperature. We do finally have a HOA meeting scheduled, may 19th at 10 or 10:30 and I for one would like to vote to abolish the whole thing and I think more than several of my neighbors are with me. The only thing Beazer's company, you should check into the legality of the Home Owner's Association set up, has done is take our money and when we ask for detail of the spending of that money or threaten back with our own attorney when we get the letter that we haven't paid our dues we get ignored and the letters stop until the next year. You could get quite a few stories from these homeowners in the Trails of Arlington if we just would speak up and force Beazer follow through with their promises or pay for us to get our home tested for mold, insulation, HVAC and so much more including correct landscaping so yards don't flood and electrical AC units do not sit in 3 or more inches of water in yards where children play!
This is the A/C Unit that is on the right side of my house sitting in at least 2 inches of water. Tell me this is normal!!!??? It will be like this for the next at least 4-5 days. It has been complained about repeatedly!! My yard did flood again and the a/c (electrical unit) that sits to the right of my house as you look at it (belongs to my neighbor) sat in several inches of water till I walked out into the puddle (not a smart thing to do when electrical things sit in water) to unclog the drains! It is ridiculous because they only made the drain to the middle of the front yard and now all the soil, etc that washes through the drain has built up around the drain and is flooding the middle of the yard.
I emailed a list of thirteen items that I needed repaired/fixed in my home in June. It is now September and I have had four (4) of those items repaired/fixed.
The two of main areas of concern now are: 1. The french drain is not pulling water off of the property in a timely manner. There was a downpour for about 30 minutes on Saturday. One hour AFTER the rain stopped, their was standing water in the front of the house about a foot deep. I am VERY disappointed at that. I was told that the water drainage would not be a problem but apparently it is.
2. This item was discussed with Chris but not in the original email. The two front windows of the house (bedroom) were not wired properly for security. I have two little ones (3 & 2 year olds) who sleep in that bedroom three nights a week. It is a real concern to me that the window is not wired. Original List: 1. The "fake" drawer in the 2nd story bathroom is not secure.
2. Window frame in the master bath not painted. 3. The front yard by the drive way has concrete poured in it as well as large pieces of wood (framing) in the front yard.
4. There are holes in the concrete going into the driveway that need filling. 5. The light fixture in the attic is broken. 6. Crack in the door molding of 2nd bedroom and bathroom downstairs. 7. The wall has a whole in it around the motion detector…the original hole was too large. 8. Garbage disposal doesn't work. 9. French drain is not pulling water off of property in a timely manner.
10. The yard was not repaired after the french drain was put in leaving several holes in the yard. The French Drain is not working and there is a pool of water standing in the yard. 11. The air conditioner rattles and makes lots of noise that can be heard in the master bedroom. 12. The window in the master bedroom is broken. 13. The window in the front bedroom is not wired for security.
I am sorry you and your family are having to live a nightmare as well. My family and I moved out Oct 05 after only living there for 6 months. My son is on asthma medicine and the rest of us allergy sinus meds as well from what we were exposed to. I still can't hear to well since moving and need tubes. The county is going after Beazer because the house was not built to code. The stucco is too thin and it is cracked between the floors that when you hold a hose up to the side water comes inside onto the floor. The hearing is in May. They have given us the run around since the day we moved in. We even went to a so called settlement meeting where a VP of finance and two reps looked at the house, shook our hands twice and told us to have a nice day. A "nice day"after all we have been through and only wanted the house fixed and the expenses that we have incurred back. We will be heading for court or arbitration after that. And I am positive that we will prevail. I have come to terms with the fact that we will never be the same after going through this and having lost a year and 1/2 of our lives as well as what this has done to our children. Besides the medical aspect, the smell was so horrible people commented everywhere we went. It got so bad that my husband and my coworkers knew we were there before they even saw us, the same thing happened at the doctors office and the kids were ridiculed at school and the teachers said they had to remove their backpacks from the rooms. It was really horrible.
I am so happy that my complaint is being viewed by others. I must say that this was a HUGE and crazy mess that went on for too long! I am out of that house and now everything is great. I ended up settling out of court for a minimal amount at my lawyer's suggestion. I was very disappointed in the results and think that if I had pushed the issue then I would have been able to do more. Basically I would be more than happy to help you in any way.
I know that there are more than 8 homes that I know of off of the top of my head with water damage found to be builder error. Mine had the mold and caused my son (who has asthma and severe allergies) health to deteriorate. I only had minimal mold though. I know that there was a house in our neighborhood that had to be gutted and redone. Beazer had to buy this house back from the home owner and they had a huge settlement that they are not able to discuss. I know that there are more...with water damage due to incorrect installation of the flashing.
As for my situation, I simply gave up. I'm a single guy and should be moving in a year or so. I'm trying to do my best to sell the house.
Beazer ended up building us and the three other neighbors that shared theditch a 15' retention wall so that we could get back half of our backyard. We all have fences that now run straight up to that retention wall and theditch is lined with large rocks so that no one would feel comfortablewalking through it and the water won't erode our land away. It wasn't easy, I got plans from the town, brought in a private engineerand went through many retries as they brought in more dirt that just gotwashed away. The neighbors and I are not happy that this ditch is here, so close and we were sold land that was supposedly "ditch free" (at least that's what we were promised). At least with the new modifications, we aren't constantly losing our yards literally down the drain though. I still have a few other issues but am hoping to have them resolved soon. My neighbors all have one issue or another, warped ceilings, floors, Ihave mold on the bricks on the front porch. The Beazer representatives in this area seem to be attempting to fix the issues (not always the best way). We have one neighbor up the street that ended up winning a suit against them for mold, I think it cost something like $40k to fix.

We bought our home in Nov 2004, moved from Florida to Indiana our first brand new home.. What a a mistake. Our garage floor has cracks all over it. It looks like it is a 30 year old house it started cracking before our 1 year walk. My master bedroon wall started bowing out along with our baseboard dropping. A crack along the ceiling all in a straight line.. We also have a crack in our foundation from day one that they assured us was ok. But all this stuff happening is all in aline with the crack in the foundation almost like our house is going to break off. Plus the side of our house is also sinking. But they still asssure us that this is normal and I must of stood on the baseboard or put a dresser on it. In our garage around our circuit breaker all the wires are in the open, which now I have been told by friends that that is a code violation, I can not stand Beazer I think they are very shading. They play the blame name game saying they bought out Trinity and Crossmann and they are the builders that had problems so they bought that also. If that was the case they would do all they could do then to fix the problems instead of doing nothing but hiding behind their high end lawyers. They fixed the bow in my wall nailed the baseboard back up and filled the crack in the ceiling with caulk which I must say is how they fix most of their problems in the one year walk through. They filled potting soil in my sinking yard in 2005. I still have a sinking yard nail pops all over circuit breaker with wires showing and cracks in my garage all over getting wider and the crack in the foundation the filled with cement is opening again.. I feal like I purchased a lemon and nothing I can do about it. My AC was also freezing up and it wasn't even 3 years old. So like you in the same boat almost I agree Beazer should be held accountable for the poor construction of their homes I would NEVER tell anyone to build a beazer home ....
Beazer Has to be the Worst Home Builder in the History Of Building Homes. I have Written Several Letters Trying to Get My Money Back to no Avail.
Hello, don't feel so bad...we have all sorts of problems with our Beazer home also. Black mold growing on the garage beams WITH FRESH SPORES as welll as in the master bedroom carpet. Cracked foundation...ect.
We have endured 4 years of a nightmare with Beazer...many others too.....
