Section 1983. Civil action for deprivation of rights
Every person who, under color of any statute, ordinance,
regulation, custom, or usage, of any State or Territory or the
District of Columbia, subjects, or causes to be subjected, any
citizen of the United States or other person within the
jurisdiction thereof to the deprivation of any rights, privileges,
or immunities secured by the Constitution and laws, shall be liable
to the party injured in an action at law, suit in equity, or other
proper proceeding for redress, except that in any action brought
against a judicial officer for an act or omission taken in such
officer's judicial capacity, injunctive relief shall not be granted
unless a declaratory decree was violated or declaratory relief was
unavailable. For the purposes of this section, any Act of Congress
applicable exclusively to the District of Columbia shall be
considered to be a statute of the District of Columbia.
Nice huh.. So here is how you can use it. Suppose you are stopped [and illegally detained]. If you are innocent and have not provided probable cause for search and siezure, STAND YOUR GROUND. Ask the officer politley what probable cause he has and whether you are being arrested. If he cannot demonstrate probable cause, he must let you go. You have rights, know them and use them. If the officer continues to try to intimidate you, it's time to play your trump card. Inform the officer of your 4th ammendment protections, then very calmly explain Title 42 Section 1983. Once you have confidently
and politley explained that you WILL sue him personally for violations of your civil rights, he will more than likely change his tune. To pull this off, you have to know what your talking about. Here is the actual language;I dont think you need to memorise this, just the Title and section numbers. Cops do know what a "1983" is..
