About me: Three and half years ago I was trying to fix a broken pipe that was leaking CO2 gas in one of my stores. I was Director of Training and Development for the McDonald's Corporation and nearly died. The EMT's did not know how to handle the situation so they sent me and another manager to our family physicians the next day. That was the legal loop hole McDonald's used to get out of paying my workman's comp.
It was a year later that I found out that within the ceiling there was both asbestos and black mold. Which has caused a multitude of health issues that my doctors to this day continue to struggle with because they don't believe in the "whole black mold thing". Daily I still take 8-12 breathing treatments along with using an inhaler throughout the day.
The doctor's cannot explain but have deemed me to ill to return to work because the CO2 gas froze my sinuses and sinus membranes which eventually just rotted and fell out so as I wait for them to grow back over the past three years I still have two years to go before everything will be back as normal. What the doctors can tell me is that I can no longer run, "Coach" little league football, or my High School aged grandkids in football, volleyball and basketball. I now suffer from Sleep Apnea since I stop breathing 17-23 times an hour which I didn't have prior. Now if I even fall asleep in the living room my wife will wake me and tell me I stopped breathing. The doctor's have told me that I suffer severely from allergies which for my 46 years I never suffered before in my life.
As I have been a professional bass tournament angler and grew up and outdoors man my entire life. Hunting, fishing, camping, hiking, skiing, ice skating/hockey and over 200 days of fishing on Lakes Mead, Mohave, Havasu, Quail (Utah), California Lakes Delta, Lake Paris. Lake Clear, Lake Castaic, Texas Lakes Lake Worth, Lake Benbrook, Lake Granbury, Lake Fork, Lake Rayburn, Lake Nagadoches and twenty other lakes. Now all of a sudden I am not safe outdoors and I am not safe indoors. It has been recommended that at 46 years old this October I move into an assisted living complex.
While receiving my final diagnosis from the number one specialist in Texas who told my retired nurse mother-in-law, my mother, my wife and myself prior to confirming a diagnosis of exposure to asbestos, CO2 poisoning and black mold that if asked him to enter a courtroom he would deny he ever said it. He also said he would not put his diagnosis on paper to be tracked down by my lawyer and I should find another specialist immediately.
After finding another specialist we were leaving his office the night before Thanksgiving 2007 and we were t-boned at about 60 miles an hour right where I sat in the car. for six months I had 4 specialist tell me there was nothing they could do for the pain or the fact I could now not walk. We were hit so hard that his license plate could be read in reverse on my door but the elderly gentleman and the 17 year old hooker that was in the suburban were not hurt the least bit.
Instead while unconscious my wife and sisters had two listen to the Police, Fire and EMT staff joke about the hooker while my wife was in tears because I was having a neck brace put on and being slid on a back board. Now I have four crushed disk and three bulging disk that can only be fixed by surgery. But nowadays because of the high rate of unsuccessful surgeries they wanted me to see a pain doctor rather than get back surgery to be more comfortable in my nice new motorized wheel chair.
This was God at work in my life because when I did see the Pain Specialist Dr. Paul Grant he found one of those little nerves that are supposed to stand straight out between your vertebrae and forced it out with an epidural shot that was supposed to bed fed slowly but to get the nerve out he slammed the hypodermic hoping it would force the nerve out and it did.
For three days me and my family kept hoping I would get out of that motorized wheelchair and on the fourth day after me and my wife holding hands the night before and praying the Lord would provide when he felt it was necessary, the following morning I woke and without thinking walked straight into the bathroom I started screaming and woke the whole house up. I could walk again I was still in severe pain and still suffer severe pain but I can walk.
The elderly man before I was able to hire a lawyer gave all his money to his daughter who lives Denver, Colorado. His $750,000 home cannot be held as a lien to damages in the accident. It was required I get an immediate Left ACL keep my left able to walk on but I still am waiting for two knee rebuilds as my knees were bent severely over the center console and obliterated my knees. But his insurance was minimum as he had recently paid off the two year old suburban and by the time it paid the bill for my surgery, my little sister whole nearly died from a neck injury, my middle sister's minor injuries.
My wife who still requires a shoulder surgery who knows how to play 37 instruments but loves the piano best may never play again in her lifetime because his insurance policy ran out of money. She did have her fingers repaired as they were crushed by my head which hit her hand on her door railing while I was in flight. Seat belts do not work in a side end (t-bone) collision and for all our pain and suffering we were awarded a $45 dollar check. Cigna my wifes insurance carrier at work was following the ridiculous situation and has agreed to provide her shoulder surgery but we will still have to pay the deductible.
I have been awarded Social Security Disability after three years because my employer the McDonald's Corporation denied my claim because the EMT's who had never-ever dealt with this type of gas inhalation sent me and the other manager to our family doctors. The judge noted it was a travesty on their (McDonald's) part and an injustice but the best he could do for me was grant my claim. He had already asked me prior why I didn't sue McDonald's and my reply was that in the two-year period that I had to sue them I had one of the strongest law firms in Texas covering me but when the states best specialist said he wouldn't go to court they dropped me. He asked why I didn't try another law firm or lawyer, I replied I had contact over 30 lawyer firms and they were straight forward and said they couldn't handle a case that would be dragged out for 10-12 years.
Now my battle is with Social Security as I did have a short term disability insurance plan with Met Life. Social Security is trying to tell us we owe them $48,990.88 and I would receive a check of $24 for 26 1/2 years to pay Met Life back. When I contacted Met Life they said they only paid me $12,375 and that they didn't request payment back as it was an insurance policy and they would never try and get those payments back. So my disability lawyer Met Life provided when my short-term disability ran out is battling these mysterious claims that Social Security has came up with and is trying to get away with. Since my lawyer filed a judgement against them they didn't even pay me my $24 dollars this month.
Try losing two homes you worked hard for in your lifetime, two cars one paid for and clear, your life savings, your IRA's, your accrued retirement all on medical and please don't give me that normally "those people do allot of people good" your experience is not the norm. I have studied who is backing the insurance companies and who fights them and that was how I found out Texas had Senator Jane Nelson and Congresswoman Kay Granger woman who are not in the pockets of insurance companies.
If not for Senator Jane Nelson and Congresswoman Kay Granger who I plan on doing volunteer work for in her Governor's race here in Texas I would still be waiting for my disability hearing in 2012. I have never missed voting since turning 18 as at the time I was a Young Republican in the State of Nevada then and now I am just older and not happy with either party. I vote for my candidates and I hold them to their promises calling them or writing them when they don't follow suit.
So other than working as a casino manager, writing for some outdoor magazines about largemouth bass fishing, building 33 websites for a venture capitalist I was involved with for two years and taking care of my family that's pretty much what I have been doing.
Recently, I took classes to be a www.iamsecond.com facilitator for small groups or just meeting folks on the streets or my local mall since I can no longer drive. Okay I have opened the door for some discussion let's talk it seem's some (not necessarily you) need a little push. Or reminders like I was voted the "Most Spirited of the Class" which I am still proud of Today.

Logan is a 13 year-old boy who lives on a ranch in a very small town in Nebraska. Logan listens to Christian Radio station 89.3FM KSBJ which broadcasts from Houston, TX. Logan called the radio station distraught because he had to take down a calf . His words have wisdom beyond his years.

First and foremost it has turned from having to find a lawyer to represent me in this CO2-Black Mold exposure case. To finding a Pulmonary Specialist that is willing to do more than tell me, and I quote "I will not take part in any court case. My company made me sign a paper stating that they would fire me if I take part in any legal proceedings’" end quote.
This has been the case regardless of any doctor I have seen NOT BORN ON AMERICAN SOIL. Nurses have came straight out and told me that their "work visa's" can be threatened along with their future citizenship. So the difficulty is finding someone who will give me a full work up and is not worried that they may be dragged into a court case. My Family Doctor who works for this same Health Organization has signed and bound by this same statement but says once given a subpoena she said that the law of medical ethics overrides this document·
So we are working as fast as we can to get me into a new Pulmonary Specialist that is recommended by Rosetta’s work. Over the past two months I have been awakened by very scared women telling me I am gasping for air. Just last night (August 26, 2008) Rosetta said that my breathing was so erratic stopping and starting that she spent two hours physically trying to wake up. Finally with her nerves pushed to her limit she was trying to physically put my CPAP mask on me and I finally awoke. Desperate, flailing my arms around in the air and notably scared. Oxygen deprived many times if I fall asleep before putting on my mask I will feel myself fall into a state where I am struggling in my mind to wake up but physically cannot.
Now I am scared to even fall asleep alone since this is happening with more frequency and my memory continues to get worse. It is so bad I will drive to my little sisters house to take a nap and have her watch TV with me so that at least somebody is there with me. We have OSHA, EPA, Senator Jane Nelson and Congresswoman Kay Granger in regards to my disability. Their response was that I was no longer suicidal and that I should be able to find a job that would allow me to work two (2) hours per shift. As noted in my restrictions from three of my doctors.

When I was in High School we interviewed Mohammed Ali and since I have always been impressed with this man. He actually spent time with a bunch of high school kids where Larry Holmes was ignorant and profane when it was his turn to be interviewed. I guess getting knocked to the mat from your sparring partner can do that on a given day.
Lou Rawls used to talk to me and my crew nightly after his shows at the Golden Nugget and was a down to earth and realistic man. But did have an eye for the ladies and had no problem letting you know that regardless of who was standing within an ear shot.
My brother Ray met Dwayne 'The Rock' Johnson at a wedding in Washington I believe and he told my brother Kendle that he was a great guy and down to earth as well. Ray said that he was able to speak in his mothers natural born language of Samoan which he found surprising. His Grandfather Peter Maivia was always my favorite “old days wrestlers” when I was a kid.
For me it would have to be Michio Kaku (born January 24, 1947 in the United States) is a Japanese American theoretical physicist, tenured professor, and co-creator of string field theory, a branch of string theory. Kaku received a B.S. (summa cum laude) from Harvard University in 1968 where he came first in his physics class. Every opportunity I get to meet the fighting men and women of this country that fights for the innocent and impoverished people of the world. For me I wish there was a way for people like me WHO TRULY believe in what these men and women are doing for us to meet the loved ones of those who we have lost. Kelsey Shelton Smith-Briggs (Oklahoma City, 28 December 2002 - Meeker, Oklahoma, 11 October 2005) was a child abuse victim.
She died at the home of her mother, Raye Dawn Smith, and her stepfather, Michael Lee Porter. Evidence indicated that Kelsey died from a blow to the abdomen. In the final months of her life she had suffered at various times a broken collarbone, broken legs, and bruises on her face and body. However, while the injuries were not confirmed to be the result of abuse, her case was watched closely by authorities, including the courts. Her biological father, Lance Briggs, was stationed at Fort Benning, Georgia awaiting separation papers when she died.
To Michael Lee Porter and anyone who would defend a lowly piece of trash that's only purpose on this earth to me was simply true evil. May God have grace on your family but may he burn your life eternally in hell.
It is said in the bible that you should turn the other cheek. But it is also said that only the good die young and I hope you live a thousand lifetimes of the brutal cruelty you inflicted on this you beautiful child. There is never a time or place that any child should be treated as you treated this child. If any readers know where you Micheal Lee Porter incarcerated I feel letters to inmates of that facility should be made aware of his crime, along with pictures of this little angel that did nothing too him. Let's not forget Judge Craig Key who after seeing that this young girl suffered two (2) broken legs awarded her back to her maternal mother and Michael Lee Porter. May God blemish your memory with this judgement sir. You could not determine responsibility in a world where Child Protection Services will swipe your child for you spanking them and leaving a mark. Your a coward and may you live a coward's life.
